PREMESSA. NOZIONE DI PACCHEttO tuRIStICO. Premesso che: a) il decreto legislativo n. 111 del 17.3.95 di attuazione della Direttiva 90/314/CE dispone a protezione del consumatore che l’organizzatore ed il venditore del pacchetto turistico, cui il consumatore si rivolge, debbano essere in possesso dell’autorizzazione amministrativa all’espletamento delle loro attività (art. 3/1 lett. a d.lgs. 111/95). b) il consumatore ha diritto di ricevere copia del contratto di vendita di pacchetto turistico (ai sensi dell’art. 6 del d. lgs. 111/95), che è documento indispensabile per accedere eventualmente al Fondo di Garanzia di cui all’art. 18 delle presenti Condizioni generali di contratto. La nozione di ‘pacchetto turistico’ (art.2/1 d.lgs. 111/95) è la seguente: I pacchetti turistici hanno ad oggetto i viaggi, le vacanze ed i circuiti “tutto compreso”, risultanti dalla prefissata combinazione di almeno due degli elementi di seguito indicati, venduti od offerti in vendita ad un prezzo forfetario, e di durata superiore alle 24 ore ovvero estendentisi per un periodo di tempo comprendente almeno una notte: a) trasporto; b) alloggio; c) servizi turistici non accessori al trasporto o all’alloggio (omissis) ....... che costituiscano parte significativa del “pacchetto turistico”. 2. FONtI LEGISLAtIVE. Il contratto di compravendita di pacchetto turistico, è regolato, oltre che dalle presenti condizioni generali, anche dalle clausole indicate nella documentazione di viaggio consegnata al consumatore. Detto contratto, sia che abbia ad oggetto servizi da fornire in territorio nazionale che estero, sarà altresì disciplinato dalle disposizioni – in quanto applicabili - della L. 27/12/1977 n°1084 di ratifica ed esecuzione della Convenzione Internazionale relativa al contratto di viaggio (CCV) firmata a Bruxelles il 23.4.1970, nonché dal sopraccitato Decreto Legislativo 111/95. 3. INFORMAZIONE OBBLIGAtORIA - SCHEDA tECNICA. L’organizzatore ha l’obbligo di realizzare in catalogo o nel programma fuori catalogo una scheda tecnica. Gli elementi obbligatori da inserire nella scheda tecnica del catalogo o del programma fuori catalogo sono: estremi della polizza assicurativa responsabilità civile; periodo di validità del catalogo o programma fuori catalogo. 4. PRENOtAZIONI. La domanda di prenotazione dovrà essere redatta su apposito modulo contrattuale, se del caso elettronico, compilato in ogni sua parte e sottoscritto dal cliente, che ne riceverà copia. L’accettazione delle prenotazioni si intende perfezionata, con conseguente conclusione del contratto, solo nel momento in cui l’organizzatore invierà relativa conferma, anche a mezzo sistema telematico, al cliente presso l’agenzia di viaggi venditrice. Le indicazioni relative al pacchetto turistico non contenute nei documenti contrattuali, negli opuscoli ovvero in altri mezzi di comunicazione scritta, saranno fornite dall’organizzatore in regolare adempimento degli obblighi previsti a proprio carico dal Decr. Legisl. 111/95 in tempo utile prima dell’inizio del viaggio. 5. PAGAMENtI. La misura dell’acconto, fino ad un massimo del 30% del prezzo, da versare all’atto della prenotazione ovvero all’atto della richiesta impegnativa e la data entro cui prima della partenza dovrà essere effettuato il saldo, almeno 30 gg. Il mancato pagamento delle somme di cui sopra alle date stabilite costituisce clausola risolutiva espressa tale da determinarne, da parte dell’agenzia intermediaria e/o dell’organizzatore la risoluzione di diritto. 6. PREZZO. Il prezzo è determinato nel contratto, con riferimento a quanto indicato in catalogo e relativo listino o programma fuori catalogo ed agli eventuali aggiornamenti degli stessi cataloghi o programmi fuori catalogo successivamente intervenuti. 7. Recesso del consumatore Al cliente che receda dal contratto prima della partenza saranno addebitati a titolo di penale, calcolata in base a quanti giorni prima dell’inizio del viaggio è avvenuto l’annullamento (il calcolo dei giorni non include quello del recesso, la cui comunicazione deve pervenire per iscritto in un giorno lavorativo antecedente quello d’inizio del viaggio): - fino a 30 gg e 50,00 del prezzo finale - da 29 a 15 gg 30% del prezzo finale - da 14 a 9 gg 60% del prezzo finale - da 8 a 5 gg 80% del prezzo finale - da 4 a 1 gg 100% del prezzo finale 180 Nessun rimborso previsto dopo tale termine e/o per partenze anticipate. Eventuali modifiche inerenti: nome intestatario della pratica, data di soggiorno, stabile, tipologia/camera etc... min. richiesto e 26,00. NB: le suddette somme dovranno essere corrisposte anche da chi non potesse effettuare il viaggio per mancanza o irregolarità dei previsti documenti personali di espatrio 8. SOStItuZIONI. Il cliente rinunciatario può farsi sostituire da altra persona sempre che: l’organizzatore ne sia informato per iscritto almeno 1 giorno lavorativo prima della data fissata per la partenza, ricevendo contestualmente comunicazione circa le generalità del cessionario; il sostituto soddisfi tutte le condizioni per la fruizione del servizio (ex art. 10 d.lgs.111/95) ed in particolare i requisiti relativi al passaporto, ai visti; il soggetto subentrante rimborsi all’organizzatore tutte le spese sostenute per procedere alla sostituzione nella misura che gli verrà quantificata prima della cessione. Il cedente ed il cessionario sono inoltre solidalmente responsabili per il pagamento del saldo del prezzo. è considerata modifica: - cambio nome del passeggero nello stesso periodo, struttura e tipologia prenotata - cambio periodo nella stessa struttura e tipologia per lo stesso passeggero prenotato. Qualsiasi altra forma di modifica non rientra nei 2 punti sopraelencati, verrà considerata come storno (vedi condizioni al punto n. 7) 9. OBBLIGHI DEI PARtECIPANtI. I partecipanti dovranno essere muniti di passaporto individuale o di altro documento valido per tutti i paesi toccati dall’itinerario, nonché dei visti di soggiorno e di transito e dei certificati sanitari che fossero eventualmente richiesti. Essi inoltre dovranno attenersi all’osservanza della regole di normale prudenza e diligenza ed a quelle specifiche in vigore nei paesi destinazione del viaggio, a tutte le informazioni fornite loro dall’organizzatore, nonché ai regolamenti ed alle disposizioni amministrative o legislative relative al servizio. I partecipanti saranno chiamati a rispondere di tutti i danni che l’organizzatore dovesse subire a causa della loro inadempienza alle sopra esaminate obbligazioni. Il consumatore è tenuto a fornire all’organizzatore tutti i documenti, le informazioni e gli elementi in suo possesso utili per l’esercizio del diritto di surroga di quest’ultimo nei confronti dei terzi responsabili del danno ed è responsabile verso l’organizzatore del pregiudizio arrecato al diritto di surrogazione. Il consumatore comunicherà altresì per iscritto all’organizzatore, all’atto della prenotazione, le particolari richieste personali che potranno formare oggetto di accordi specifici sulle modalità del viaggio, sempre che ne risulti possibile l’attuazione. 10. CLASSIFICAZIONE ALBERGHIERA. La classificazione ufficiale delle strutture alberghiere viene fornita in catalogo od in altro materiale informativo soltanto in base alle espresse e formali indicazioni delle competenti autorità del paese in cui il servizio è erogato. In assenza di classificazioni ufficiali riconosciute dalle competenti Pubbliche Autorità dei paesi anche membri della UE cui il servizio si riferisce, l’organizzatore si riserva la facoltà di fornire in catalogo o depliant una propria descrizione della struttura ricettiva, tale da permettere una valutazione e conseguente accettazione della stessa da parte del consumatore. 11. REGIME DI RESPONSABILItÀ’. L’organizzatore risponde dei danni arrecati al consumatore a motivo dell’inadempimento totale o parziale delle prestazioni contrattualmente dovute, sia che le stesse vengano effettuate da lui personalmente che da terzi fornitori dei servizi, a meno che provi che l’evento è derivato da fatto del consumatore (ivi comprese iniziative autonomamente assunte da quest’ultimo nel corso dell’esecuzione dei servizi turistici) o da circostanze estranee alla fornitura delle prestazioni previste in contratto, da caso fortuito, da forza maggiore, ovvero da circostanze che lo stesso organizzatore non poteva, secondo la diligenza professionale, ragionevolmente prevedere o risolvere. Il venditore presso il quale sia stata effettuata la prenotazione del servizio non risponde in alcun caso delle obbligazioni nascenti dall’organizzazione del viaggio, ma è responsabile esclusivamente delle obbligazioni nascenti dalla sua qualità di intermediario e comunque nei limiti per tale responsabilità previsti dalle leggi o convenzioni sopra citate. 12. OBBLIGO DI ASSIStENZA. L’organizzatore è tenuto a prestare le misure di assistenza al consumatore imposte dal criterio di diligenza professionale esclusivamente in riferimento agli obblighi a proprio carico per disposizione di legge o di contratto. L’organizzatore ed il venditore sono esonerati dalle rispettive responsabilità, quando la mancata od inesatta esecuzione del contratto è imputabile al consumatore o è dipesa dal fatto di un terzo a carattere imprevedibile o inevitabile, ovvero da un caso fortuito o di forza maggiore. 13. RECLAMI E DENuNCE. Ogni mancanza nell’esecuzione del contratto deve essere contestata dal consumatore senza ritardo affinché l’organizzatore, il suo rappresentante locale o l’accompagnatore vi pongano tempestivamente rimedio. Il consumatore può altresì sporgere reclamo mediante l’invio di una raccomandata, con avviso di ricevimento, all’organizzatore o al venditore, entro e non oltre dieci giorni lavorativi dalla data del rientro presso la località di partenza. 14. ASSICuRAZIONE CONtRO LE SPESE DI ANNuLLAMENtO E DI RIMPAtRIO. Se non espressamente comprese nel prezzo, è possibile, ed anzi consigliabile, stipulare al momento della prenotazione presso gli uffici dell’organizzatore o del venditore speciali polizze assicurative contro le spese derivanti dall’annullamento del pacchetto, infortuni e bagagli. Sarà altresì possibile stipulare un contratto di assistenza che copra le spese di rimpatrio in caso di incidenti e malattie. 15. FONDO DI GARANZIA. E’ istituito presso la Direzione Generale per il Turismo del Ministero delle Attività Produttive il Fondo di Garanzia cui il consumatore può rivolgersi (ai sensi dell’art. 21 D. lgs. 111/95), in caso di insolvenza o di fallimento dichiarato del venditore o dell’organizzatore, per la tutela delle seguenti esigenze: a) rimborso del prezzo versato; b) suo rimpatrio nel caso di viaggi all’estero Il fondo deve altresì fornire un’immediata disponibilità economica in caso di rientro forzato di turisti da Paesi extracomunitari in occasione di emergenze imputabili o meno al comportamento dell’organizzatore. Le modalità di intervento del Fondo sono stabilite con decreto del Presidente del Consiglio dei Ministri del 23/07/99, n. 349 G.U. n. 249 del 12/10/1999 (ai sensi dell’art. 21 n.5 D. lgs. n.111/95). ADDENDuM CONDIZIONI GENERALI DI CONtRAttO DI VENDItA DI SINGOLI SERVIZI tuRIStICI A) DISPOSIZIONI NORMAtIVE. I contratti aventi ad oggetto l’offerta del solo servizio di trasporto, di soggiorno, ovvero di qualunque altro separato servizio turistico, non potendosi configurare come fattispecie negoziale di organizzazione di viaggio ovvero di pacchetto turistico, sono disciplinati dalle seguenti disposizioni della CCV: art. 1, n.3 e n.6; artt. da 17 a 23; artt. da 24 a 31, per quanto concerne le previsioni diverse da quelle relative al contratto di organizzazione nonché dalle altre pattuizioni specificamente riferite alla vendita del singolo servizio oggetto di contratto. B) CONDIZIONI DI CONtRAttO. A tali contratti sono altresì applicabili le seguenti clausole delle condizioni generali di contratto di vendita di pacchetti turistici sopra riportate: art. 4; art. 5; art. 6; art. 7; art. 8; art. 9; art. 10; art. 11; art. 12; art. 13; art. 14; art. 15. L’applicazione di dette clausole non determina assolutamente la configurazione dei relativi contratti come fattispecie di pacchetto turistico. La terminologia delle citate clausole relativa al contrattodi pacchetto turistico (organizzatore. viaggio ecc.) va pertanto intesa con riferimento alle corrispondenti figure del contratto di vendita di singoli servizi turistici (venditore, soggiorno ecc.). ANMELDuNG uND BEStätIGuNG Mit der Anmeldung bietet der Kunde dem Reisevermittler den Abschluss des Mietvertrages verbindlich an. Die Anmeldung kann schriftlich, mündlich oder fernmündlich vorgenommen werden. Sie erfolgt durch den Anmelder auch fuer alle in der Anmeldung mitaufgeführten Teilnehmer, für deren Vertragspflichten der Anmelder wie für seine eigenen Verpflichtung einsteht, sofern er eine dahingehende, ausdrückliche Verpflichtung übernommen hat. Der Reisevertrag kommt durch die schriftliche Bestätigung von Superadria zustande, wobei die Korrektur von Irrtümern aufgrund von Druck- oder Rechenfehler vorbehalten bleibt. Buchungen unter einer Bedingung oder mündliche Nebenabreden sind nur dann gültig, wenn Sie von Superadria schriftlich bestätigt werden. 2. BEZAHLuNG Bei Vertragsabschluss ist eine Anzahlung von mindestens 10% des Mietpreises zu leisten. Den restlichen Reisepreis zahlen Sie bis 4 Wochen vor Reiseantritt, wenn Sie die Reiseunterlagen in Ihrem Reisebüro abholen. Insolvenzversicherung: Wir sind nur dann berechtigt, von Ihnen die Zahlung des Reisepreises zu verlangen, wenn sichergestellt ist, dass Ihnen bei Ausfall von Reiseleistungen infolge Zahlungsunfähigkeit oder Konkurses des Reiseveranstalter der gezahlte Reisepreis und notwendige Aufwendungen für die Rückreise erstattet werden (§ 651 k BGB). Der Sicherungsschein, der Ihnen bei Zahlungsunfähigkeit oder Konkurs den direkten Anspruch gegen den Versicherer verbrieft, wird Ihnen spätestens mit den Buchungsunterlagen ausgehändigt. Reiseschutz:Bitte beachten Sie, dass die in diesem Katalog genannten Reisepreise keine Reiserücktritts-Kosten-Versicherung (RRV) enthalten. Wenn Sie vor Reiseantritt von Ihrer Reise zurücktreten, entstehen Stornokosten; aus diesem Grund empfehlen wir den Abschluss einer RRV. 3. LEIStuNGEN Der Umfang der vertraglich vereinbarten Leistungen ergibt sich aus der Leistungsbeschreibung beim jeweiligen Angebot, den allgemeinen Informationen im Katalog, sowie aus den entsprechenden Angaben in der Reisebestätigung. Die im Prospekt enthaltenen Angaben sind für uns bindend. Wir behalten uns jedoch ausdrücklich das Recht vor, aus sachlich berechtigten, erheblichen und nicht vorhersehbaren Gründen vor Vertragsabschluss eine Änderung der Prospektangaben zu erklären, über die wir Sie vor der Buchung Ihrer Reise selbstverständlich informieren werden. 4. LEIStuNGS- uND PREISäNDERuNGEN Änderungen oder Abweichungen einzelner Reiseleistungen von dem vereinbarten Inhalt des Reisevertrages , die nach Vertragsabschluss notwendig werden und die von uns nicht wider Treu und Glauben herbeigeführt wurden, sind gestattet, soweit die Änderungen oder Abweichungen nicht erheblich sind und den Gesamtzuschnitt der gebuchten Reise nicht beeinträchtigen. Eine Erhöhung ist nur zulässig, sofern zwischen Vertragsabschluss und dem vereinbarten Reisetermin mehr als 4 Monate liegen und die zur Erhöhung führenden Umstände vor Vertragsabschluss noch nicht eingetreten und bei Vertragsabschluss für uns nicht vorhersehbar waren. Im Falle einer nachträglichen Änderung des Reisepreises haben wir Sie unverzüglich zu informieren. Preiserhöhungen ab dem 20. Tag vor Reiseantritt sind unwirksam. Bei Preiserhöhungen um mehr als 5% sind Sie berechtigt, ohne Gebühren vom Reisevertrag zurückzutreten oder die Teilnahme an einer mindestens gleichwertigen Reise zu verlangen, wenn wir in der Lage sind, eine solche Reise ohne Mehrpreis für Sie aus unserem Reiseangebot anzubieten. Die vorgenannten Rechte wollen Sie bitte unverzüglich nach unserer Erklärung über die Preiserhöhung uns gegenüber geltend machen. 5. GEWäHRLEIStuNG 5.1 ABHILFE uND MItWIRKuNGSPFLICHtEN Wird die Reise nicht vertragsgemäß erbracht, so können Sie Abhilfe verlangen. Dazu bedarf es – unbeschadet unserer vorrangigen Leistungspflicht – Ihrer Mitwirkung. Deshalb sind Sie verpflichtet, alles Ihnen Zumutbare zu tun, um zu einer Behebung der Störung beizutragen und einen eventuell entstehenden Schaden möglichst gering zu halten oder ganz zu vermeiden. Sie sind insbesondere verpflichtet, Ihre Beanstandungen unverzüglich dem oertlichen Leistungstraeger (Besitzer, Schluesselhalter, Agentur usw.) mitzuteilen. Dieser ist beauftragt fuer Abhilfe zu sorgen. Wenden Sie sich dazu bitte zunächst an unsere örtlichen Vertreter im jeweiligen Zielgebiet (siehe Reiseunterlagen). Sofern die Reiseunterlagen keinen Hinweis auf einen örtlichen Vertreter enthalten, setzen Sie sich bitte direkt mit uns in Verbindung (siehe Reiseunterlagen). 5.2 MINDERuNG DES REISEPREISES Für die Dauer einer nicht vertragsgemäßen Erbringung der Reise können Sie eine entsprechende Herabsetzung des Reisepreises verlangen (Minderung). Die Minderung tritt nicht ein, soweit Sie es schuldhaft unterlassen haben, den Mangel anzuzeigen. 5.3 Kündigung des Vertrages Wird die Reise infolge eines Mangels erheblich beeinträchtigt und leisten wir innerhalb einer angemessenen Frist keine Abhilfe, obwohl Sie diese verlangt haben, so können Sie im Rahmen der gesetzlichen Bestimmungen den Reisevertrag kündigen. Sie schulden uns dann den auf die in Anspruch genommenen Leistungen entfallenden Teil des Reisepreises. 6. HAFtuNG Superadria haftet im Rahmen der Sorgfaltspflicht eines ordentlichen Kaufmanns fuer: a. die gewissenhafte Reisevorbereitung b. die sorgfältige Auswahl und Überwachung der Leistungstraeger c. die Richtigkeit der Beschreibung aller in den Katalogen angegebenen Reisedienstleistungen, sofern wir nicht gemäß Ziff. 3 vor Vertragsabschluss eine Änderung der Prospektangaben erklärt haben, jedoch nicht für Angaben in Orts-, Hoteloder anderen nicht von uns herausgegebenen Prospekten, die von unseren Buchungsstellen abgegeben worden oder Ihren Reiseunterlagen beigefügt sind d. die ordnungsgemaesse Erbringung der vereinbarten Reiseleistungen. Eine Haftung fuer gelegentliche Ausfälle bzw. Störungen in der Wasser- und/oder Stromversorgung wird hiermit jedoch ausgeschlossen, ebenso eine Haftung für ständige Betriebsbereitschaft von Einrichtungen wie: Heizung, Lift, Klimaanlage, Swimmingpool usw. Alle Angaben, die nicht das Mietobjekt selbst betreffen, werden ebenfalls sorgfältig recherchiert; sie erfolgen jedoch ohne Gewähr, da diese oft aus Angaben von Drittpersonen und - Organisationen beruhen. Erfüllungshilfen Wir haften für ein Verschulden der mit der Leistungserbringung betrauten Personen. 7. SuPERADRIA uND HÖHERE GEWALt. Im Ferienverkehr können immer wieder Extremfälle auftreten, für die wir nichts können. Hindern uns höhere Gewalt Streik oder Beförderungsschwierigkeiten an unserer Vermittlungstätigkeit, so sind wir berechtigt, die Buchung entschädigungslos zu kündigen. Verhindern andere Gründe, die ebensfalls von uns nicht zu vertreten sind, das Erbringen der Leistung, so können wir Sie entweder in eine andere Ferienwohnung oder ein anderes Hotel umbuchen oder notfalls die Buchung kündigen. In diesem Falle erhalten Sie den einbezahlten Betrag zurück, verzichten jedoch auf weitere Ansprüche. 8. AuFHEBuNG DES VERtRAGES WEGEN HÖHERER GEWALt Wird die Reise nach Vertragsabschluss durch nicht voraussehbare höhere Gewalt erheblich erschwert, gefährdet oder beeinträchtigt, so können sowohl Sie als auch wir den Vertrag kündigen. Wird der Vertrag gekündigt, so können wir für die bereits erbrachten oder zur Beendigung der Reise noch zu erbringenden Reiseleistungen eine angemessene Entschädigung verlangen. 9. RÜCKtRItt DES KuNDEN, uMBuCHuNG, ERSAtZtEILNEHMER 9.1 RÜCKtRItt Treten Sie vom Reisevertrag zurück oder treten Sie die Reise nicht an, können wir Ersatz für die getroffenen Reisevorkehrungen und unsere Aufwendungen verlangen. Unser Ersatzanspruch ist unter Berücksichtigung der gewöhnlich ersparten Aufwendungen und möglichen anderweitigen Verwendung pauschaliert. Die Höhe des Ersatzanspruches entnehmen Sie bitte Ziffer 10 dieser Reisebedingungen. Es bleibt Ihnen der Nachweis unbenommen, dass kein oder ein wesentlich geringer Schaden entstanden ist, als die von uns geforderte Pauschale. 9.2 uMBuCHuNG Sollen auf Ihren Wunsch nach der Buchung der Reise Änderungen hinsichtlich des Reisetermins, des Reiseziels, des Ortes, des Reiseantritts oder der Unterkunft vorgenommen werden, so entstehen uns in der Regel die gleichen Kosten wie bei einem Rücktritt Ihrerseits. Wir müssen Ihnen daher die Kosten in gleicher Höhe berechnen, wie sie sich im Umbuchungszeitpunkt für einen Rücktritt ergeben hätten. Bei anderweitigen, geringfügigen Änderungen berechnen wir jedoch nur eine Bearbeitungsgebühr von EUR 26. 9.3 ERSAtZtEILNEHMER Bis zum Reisebeginn kann sich jeder angemeldete Reiseteilnehmer durch einen Dritten ersetzen lassen, wenn uns diese Aenderung mitgeteilt wird. Wir können jedoch dem Wechsel in der Person des Reisenden widersprechen, wenn dieser den besonderen Reiseerfordernissen nicht genügt oder seiner Teilnahme gesetzliche Vorschriften oder behördliche Anordnungen entgegenstehen. Tritt eine Ersatzperson in den Vertrag ein, so haften Sie mit dieser zusammen als Gesamtschuldner für den Reisepreis und die durch den Eintritt des Dritten entstandenen Mehrkosten. 9.4 Schriftform Rücktritts-, Umbuchungs- und Änderungserklärungen sind grundsätzlich formlos möglich, sollten in Ihrem Interesse aus Beweisgründen aber in jedem Fall schriftlich erfolgen. 9.5. Folgendes wird als änderung betrachtet: - Wechsel des Klienten im gleichen Zeitraum, Struktur und gebuchter Typologie - Wechsel des Zeitraums in gleicher Struktur und Typologie für denselben gebuchten Klienten Jegliche weitere nicht o.g. Änderungsform wird als Stornierung betrachtet (siehe Punkt 10) 10. RÜCKtRIttSPAuSCHALE Beachten Sie bitte unbedingt etwaige abweichende Angaben beim einzelnen Angebot. DAtENSCHutZ Alle personenbezogenen Daten, die Sie uns zur Abwicklung Ihrer Reise zur Verfügung stellen, sind gemäß Bundesdatenschutz gegen missbräuchliche Verwendung geschützt. SONStIGE HINWEISE Telefon, Telex- und Telegrammkosten können bei kurzfristigen Buchungen gesondert in Rechnung gestellt werden. Für die Einhaltung der Pass-, Visa-, Devisen und Zollbestimmungen ist der Reisende selbst verantwortlich. Das gilt auch für das Mitführen aller anderen für die Reise notwendigen Unterlagen. Alle Kosten und Nachteile aus der Nichtbeachtung dieser Hinweise gehen zu Lasten des Reisenden. COMPuLSORY INFORMAtION - tECHNICAL REPORt The organizer shall be responsible to provide a catalogue that incorporates a technical report. The report must include information regarding insurance liability and the expiry date of the catalogue. 2. BOOKING Booking must be made out on the official contract forms supplied. The client must undersign and retain one copy of the contract form. The booking may only be considered as confirmed after the organizer has sent a written confirmation, that may also be sent via telefax or e-mail. Additional information not already specified in the contract must be supplied well in advance by the organizer according to legislative decree 111/95. 3. PAYMENtS A deposit of 30% must be made upon booking and the balance to be paid 30 days before arrival. Should payment not be made as stipulated both the travel agency and the organizer have the right to cancel the agreement. 4. PRICE The price is stipulated in the contract, with reference to the facilities and services presented in the brochure, that may be updated from time to time. 5. CANCELLAtION The client who withdraws from the contract before the fixed arrival date, will incure a penalty charge, based on the total number of days left between cancellation and departure date (notice of withdrawal must be receveid by the travel agency at least one working day before the clients set off the journey) Please note that withdrawal day will not be added to the total number of days when calculating the penalty charge. Penalty charges are as follows: • Up to 30 days Euro 50,00 • 29 to 15 days 30% of the total price • 14 to 9 days 60% of the total price • 8 to 5 days 80% of the total price • 4 to 1 days 100% of the total price No refound will be given after these dates. The above mentioned cancellation fees must be paid even when cancellation are made to lack of visa requirements. 6. tRANSFERABLE BOOKINGS Clients who choose to transfer their booking to a third party are responsible to forward in writing details of the third party at least one day before arrival. Moreover the third party has to pay all the expenses related to the change of contract. The organizer will hold both the original and the third party responsible for the balance of payment. • Modifications and cancellation Transfering of the booking to a third party, without modifying the programme is considered a modification not a cancellation. Also changing the starting and ending dates of the booking by the original client, without affecting the duration of the booking will also be considered a modification. Any other changing not included in the above mentioned terms, will be considered as cancellation. Mimimum charge Euro 26,00. 7. OBLIGAtIONS OF tHE PARtICIPANtS: The participants are requested to bring a valid passport or any other valid identity document as well as permit of stay and health certificate. The participant are also requested to observe the rules of ordinary diligence and to follow all the suggestions received by the organizer. Failing to do so will render the participants liable for any damage caused. 8. HOtEL CLASSIFICAtION The official classification of the hotels can be found in the catalogue or in other information material and depends only on what is specificly indicated by the local competent authorities where the holiday complex is located. When the official classification recognized by the competent public authorities is unavailable, the organizers can express their own opinion of the hotel gradin to act as a guideline to consumers. 9. LIABILItY The organizer agrees to imdemnify the consumers against any damages incurred by them arising directly or indirectly out of any failure or alleged failure by the organizer or its servants unless there is evidence that the events happened due to acts of the consumers, or due to circumstances that the organizer could not reasonably forsee using its professional diligence. The seller is by no means responsible for the obligations concer- 182 ning the organization of the journey but only for the obligations arising from its middleman role and as required by law. 10. ASSIStANCE The organizer is requested to assist the consumer as fixed by the professional diligence principles with reference only to the duties imposed by the contract or by the statutory provisions. The organizer and the seller are not responsible for the failing of the contract, when this depends on acts of the consumer or of a third party or on unpredictable, inevitable circumstances or on fortuitos event. 11. COMPLAINtS AND REPORtS Any failure to meet the contract has to be notified by the consumer without delay, so that the organizer can find an alternative solution as soon as possible. The consumer can lodge a claim with a registered letter to the organizer or to the seller not later than 10 days from the end of the programme. 12. INSuRANCE If not clearly expressed as being covered in the price, all insurance expenses must be paid by the consumer. It is possible, and also recommended to take out medical and equipment baggage insurance. It is also possible to insurance against the consequences of cancellation due to circumstances such as illness. 13. GuARANtEE FuND In the case of bankruptcy of the organizer, the consumer may apply for a refund to the guarantees funds office at the National Ministry of Tourism. In case of emergency, consumers can apply to the same office for financial assistance with travel expenses. Program valid from 01/10/2013 till 31/12/2014.
