– Il presente listino sostituisce ed annulla tutti i precedenti.
– Le proposte di ordine si accettano solo se inviate per iscritto, via fax o
per e-mail. La proposta sarà ritenuta valida solo ad avvenuta conferma
d’ordine da parte della ricevente. Eventuali variazioni verranno
considerate solo se effettuate entro 48 ore dal ricevimento della conferma
d’ordine. La società si riserva di valutare se dette variazioni comportano
differenze di prezzo.
– I termini di consegna sono da considerarsi puramente indicativi e non
danno luogo, in nessun caso né a indennità né a risoluzione dell’ordine.
– I prezzi indicati sono da considerarsi IVA esclusa; in caso di ritardato
pagamento la società si riserva la facoltà di applicare gli interessi di
mora e di addebitare eventuali costi sostenuti.
– Le presenti condizioni di vendita si intendono integralmente accettate
con il conferimento dell’ordine e/o con il ritiro dei prodotti e possono
essere soggette a cambiamenti senza alcun preavviso.
– La merce viaggia a rischio del committente anche se spedita in Porto
Franco. La merce rimane di riservato dominio della fornitrice fino a
completo avvenuto pagamento, fermo restando la responsabilità del
committente della buona conservazione materiale.
– La merce viene spedita franco destino su tutto il territorio nazionale per
ordini superiori a 800,00 Euro; per ordini inferiori a tale cifra la società
addebiterà un contributo spese in fattura.

immagini dei cataloghi sono puramente indicativi. Per quanto si ponga
attenzione risulta praticamente impossibile una perfetta corrispondenza
degli stessi nel tempo: pertanto non verranno accettate contestazioni per

– Le contestazioni relative ad ogni fornitura saranno accettate solo

alla venditrice entro otto giorni dalla data di consegna in caso di
deterioramento. In ogni caso non si accettano resi deteriorati e/o lordati
da parte del cliente.
– La società si riserva di apportare senza preavviso variazioni alle
condizioni di vendita, ai prodotti e al processo di realizzazione.
I prodotti sono coperti da garanzia in caso di utilizzo normale e
idoneo del prodotto. I meccanismi e le alzate a gas hanno due anni di
garanzia, che iniziano dalla data di spedizione del prodotto stesso. Sono
espressamente esclusi dalla garanzia: un utilizzo scorretto o eccessivo del
prodotto, la normale usura dei materiali, difetti e problemi causati da una
scorretta collocazione e/o conservazione del prodotto, materiali forniti
dal cliente, lavorazioni speciali richieste.
– Lavorazioni particolari e/o su misura devono essere espressamente
accettate con la conferma d’ordine. La società si riserva di calcolare e
valutare il prezzo degli elementi su misura.
– I nostri prodotti sono lavorati e rifiniti artigianalmente: pertanto sono
possibili lievi differenze delle misure effettive rispetto a quelle indicate a
listino (in ogni caso non superiori all’1%).
– Con il ricevimento del presente listino, il committente da il proprio
consenso all’uso dei propri dati personali, ivi compresa la comunicazione
a terzi; in qualunque momento potrà modificare, conoscere o far
cancellare i propri dati a mezzo di semplice comunicazione scritta.
– Per tutte le controversie viene stabilita la competenza esclusiva
del Foro di Bolzano
Allgemeine Verkaufsbedingungen
– Diese Preisliste ersetzt bzw. annulliert alle vorhergehenden. – Bestellungen werden ausschließlich schriftlich, per Fax oder E-Mail
angenommen. Jeder Auftrag ist nur nach erfolgter Akzeptierung seitens
des Auftragsempfängers gültig. Eventuelle Änderungen und Ergänzungen
können nur berücksichtigt werden, wenn diese schriftlich innerhalb 48
Stunden nach erfolgter Akzeptierung des Auftrags eingehen. In diesem
Falle behalten wir uns das Recht vor, eventuell entstandene Preisdifferenzen
zusätzlich zu berechnen.
– Die Liefertermine sind als indikativ zu betrachten und geben in keinem Fall
Anrecht auf Schadenersatz, noch kann die Bestellung in Bezug darauf
annulliert werden.
– Die angegebenen Preise verstehen sich exklusive MwSt. Bei Zahlungsverzug
behalten wir uns das Recht vor, Verzugszinsen und eventuell anfallende
Spesen zu berechnen.
– Mit der Auftragserteilung oder Warenannahme gelten unsere
Verkaufsbedingungen als akzeptiert. Diese können auch ohne
Vorankündigung eventuellen Änderungen unterliegen.
– Die Lieferung der Ware erfolgt, auch wenn „frei Haus“, auf Risiko des
Auftraggebers. Bis zur vollständigen Bezahlung des Kaufpreises bleiben alle
Liefergegenstände unser Eigentum, wobei der Käufer die Verantwortung für
die sachgemäße Handhabung und Lagerung der Ware trägt.
– Lieferungen mit einem Warenwert von mehr als 800 Euro erfolgen im
gesamtstaatlichen Raum „frei Haus“. Für Aufträge unter 800 Euro wird ein
Frachtkostenbeitrag in Rechnung gestellt.
– Die Farben der Bezüge und Accessoires in unseren Musterkatalogen sowie
die Abbildungen in den Katalogen sind nicht farbverbindlich,
denn auch unter Anwendung größter Sorgfalt ist eine komplette
Übereinstimmung mit dem Lieferobjekt über längere Zeit hin unmöglich.
Deshalb können Farbabweichungen, insbesondere bei Nachbestellungen,
nicht ausgeschlossen werden. Diesbezügliche Reklamationen
werden nicht angenommen.
– Beanstandungen, die eine unvollständige Lieferung betreffen, müssen
unverzüglich bei Erhalt der Lieferung auf dem Lieferschein vermerkt
werden. Beanstandungen für Mängel müssen innerhalb von 8 Tagen
schriftlich direkt der Verkaufsstelle mitgeteilt werden.
Die Rücknahme von Ware, die durch den Kunden beschädigt
oder beschmutzt wurde, ist ausgeschlossen.
– Die Firma behält sich das Recht vor, eventuelle Änderungen an
Produkten, am Fertigungsprozess und bei den Verkaufskonditionen ohne
Vorankündigung vorzunehmen. Die Garantie gilt nur bei normalem
und fachgemäßem Gebrauch der Ware. Auf Mechanismen und
Gasdruckfedern wird eine Garantie von 2 Jahren gewährt, welche mit
dem Lieferdatum des Produktes beginnt. Von der Garantie ausdrücklich
ausgeschlossen sind: der unkorrekte und exzessive Gebrauch der Ware;
die natürliche Abnutzung der Materialien; Defekte und Probleme, welche
aufgrund eines falschen Standortes und/oder falscher Lagerung des
Produktes entstanden sind; Materialien, welche vom Kunden geliefert
wurden, sowie spezielle, vom Kunden erwünschte Fertigungen.
– Aufträge für „Sonderanfertigungen“ und/oder Maßanfertigungen werden
nur dann angenommen, wenn diese vom Auftragsempfänger schriftlich
akzeptiert werden. Wir behalten uns das Recht vor, den Preis für
Sonderanfertigungen nach Arbeitsaufwand zu kalkulieren
und dem Kunden zu berechnen.
– Da unsere Modelle handwerklich angefertigt werden, sind geringfügige
Maßabweichungen (in jedem Fall nicht mehr als +/- 1%) von den Angaben
der Preisliste möglich. – Mit dem Erhalt dieser Preisliste erteilt der Auftraggeber sein Einverständnis
zur Verwaltung seiner persönlichen Daten bzw. zur Weiterleitung
derselben an Dritte. Der Auftraggeber kann jederzeit Einsicht in seine
Daten nehmen, diese abändern oder die Löschung mittels
schriftlicher Mitteilung fordern. – Für jegliche Rechtsstreitigkeiten ist ausschließlich der
Gerichtsstandort Bozen zuständig.
– Bei Rechtsstreitigkeiten gilt die Formulierung der
Verkaufsbedingungen in italienischer Sprache.
