Sintesi delle attività durante la sesta legislatura, 2004-2009
Introduzione
Il Parlamento europeo ha acquisito una crescente autorevolezza in materia di diritti umani e
nelle questioni concernenti la democrazia. Esso contribuisce all'elaborazione, all'attuazione e
alla valutazione delle politiche dell'Unione nel settore dei diritti umani attraverso le sue
risoluzioni, relazioni, missioni in paesi terzi, manifestazioni nell'ambito dei diritti umani,
delegazioni interparlamentari e commissioni parlamentari congiunte con paesi terzi,
interrogazioni orali e scritte, audizioni speciali su questioni specifiche, nonché il suo annuale
premio Sacharov. Il Presidente del Parlamento, inoltre, affronta regolarmente questioni
concernenti i diritti umani negli incontri con rappresentanti di paesi terzi.
La sottocommissione per i diritti dell'uomo, ricostituita nel 2004, all'inizio della sesta
legislatura, sotto la presidenza di Hélène Flautre (Verts/ALE), è divenuta la sede principale
delle discussioni sui diritti umani in Parlamento. Ha dato impulso a numerose iniziative
parlamentari nel settore e fornisce un forum permanente di discussioni sulla situazione dei
diritti dell'uomo e lo sviluppo della democrazia in paesi terzi con altre istituzioni UE, con i
relatori speciali dell'ONU e i rappresentanti del PSNU, con il Consiglio d'Europa, con i
rappresentanti dei governi, con gli attivisti per i diritti umani e con le ONG. Ha effettuato
visite individuali, a mezzo di delegazioni, a paesi terzi che ambiscono ad aderire all'Unione
europea (Turchia e Croazia). Uno dei principali obiettivi che la sottocommissione si è prefissa
è quello di contribuire all'integrazione delle questioni concernenti i diritti umani in tutti gli
aspetti delle relazioni esterne dell'UE e nelle relative attività del Parlamento. Ha agito in
questo senso elaborando, tra l'altro, orientamenti per tutte le delegazioni interparlamentari del
PE con paesi terzi.
Grande impegno è stato profuso al fine di controllare e valutare l'attuazione degli strumenti
dell'UE nel settore dei diritti umani. In questo contesto, la sottocommissione ha attribuito una
particolare importanza all'attuazione dello strumento finanziario dell'UE "Iniziativa europea
per la democrazia e i diritti umani" e degli orientamenti dell'UE in materia di diritti umani.
Durante la sesta legislatura, un'attenzione particolare è stata rivolta agli orientamenti in
materia di pena di morte, di tortura e dei dialoghi in corso sui diritti umani.

1. Settori di responsabilità e composizione

La sottocommissione per i diritti dell'uomo (DROI) è stata ricostituita nel 2004 come
sottocommissione della commissione per gli affari esteri.
Il principale ambito di responsabilità della sottocommissione è esposto all'allegato VI, sez. I,
punto 5 del regolamento del Parlamento europeo.
"[...] le questioni concernenti i diritti dell'uomo, la protezione delle minoranze e la
promozione dei valori democratici nei paesi terzi; in questo contesto la commissione è
assistita da una sottocommissione per i diritti dell'uomo; fatte salve le disposizioni pertinenti,
alle riunioni della sottocommissione sono invitati membri di altre commissioni ed organi
dotati di competenze in questo settore".

La sottocommissione era composta di 32 membri del Parlamento europeo, che potevano
essere sostituiti da altrettanti supplenti. Le principali decisioni riguardanti il lavoro della
sottocommissione (ordini del giorno, delegazioni, questioni da discutere) venivano adottate
dall'Ufficio di presidenza allargato della sottocommissione, formato dal presidente, Hélène
Flautre, dai quattro vicepresidenti, Richard Howitt (PSE), Patrick Gaubert (PPE-DE),
Baroness Sarah Ludford (ALDE), Jozef Pinior (PSE), e da sette coordinatori, ciascuno in
rappresentanza di un gruppo politico: Laima Andrikiene (PPE, in sostituzione di Simon
Coveney dal 2007), Raimon Obiols i Germa (PSE, in sostituzione di Elena Valenciano dal
2007), Marco Cappato (ALDE), Raul Romeva i Rueda (Verts/ALE), Vittorio Agnoletto
(GUE/NGL), Inese Vaidere (UEN) e Irena Belohorska (NI).
2. Valutazione dell'esecuzione degli strumenti UE per i diritti umani: verso una
maggiore responsabilizzazione della Commissione e del Consiglio
Uno dei compiti principali della sottocommissione è stato quello di analizzare e dare seguito,
tramite azioni appropriate, all'esecuzione dei diversi strumenti resi disponibili dall'Unione
europea nel settore dei diritti umani e della tutela della democrazia: gli strumenti finanziari,
gli orientamenti in materia di diritti umani, il dialogo sui diritti umani e le relazioni del
Consiglio.
Oltre all'analisi e alla valutazione della politica dell'UE in materia di diritti umani e di
democrazia, il ruolo della sottocommissione è stato anche quello di responsabilizzare la
Commissione e il Consiglio. La sottocommissione, pertanto, ha compiuto tutti gli sforzi
possibili per assicurare il mantenimento di un dialogo costante con la Commissione e con il
Consiglio. Inoltre, ha espresso il proprio parere sulle azioni da essi intraprese nell'ambito dei
diritti umani, ha vigilato sul loro raggiungimento degli scopi prioritari in tale ambito, spesso

identificati di comune accordo, e li ha esortati all'azione nel momento in cui risultava
necessaria una strategia comune o un'azione congiunta.
In tutti gli incontri, la Commissione è stata rappresentata dall'Unità diritti umani della
Direzione per le relazioni esterne (RELEX) DG (B1).
Le presidenze di turno successive hanno preso parte regolarmente agli incontri della
sottocommissione, rappresentate dalla presidenza del Gruppo "Diritti umani" del Consiglio
(COHOM) o da un altro funzionario dello Stato membro che deteneva la presidenza. Hanno
presenziato in numerose occasioni a nome di Javier Solana, rimanendo attivamente coinvolti
nel lavoro della sottocommissione, Michael Matthiessen e, dal 2007, Riina Kionka,
rappresentante personale per i diritti umani dell'Alto rappresentante della PESC. A partire dal
2004, la presidenza della sottocommissione è stata inoltre invitata a partecipare alle riunioni
del Gruppo "Diritti umani" del Consiglio (COHOM) e a colazioni di lavoro informali del
Gruppo "Pace e sicurezza" del Consiglio (COPS).
Sempre dal 2004 in poi, la sottocommissione ha inoltre istituito una nuova procedura che
consente agli Stati membri individuali di rivolgere delle interrogazioni alla Commissione su
specifiche questioni attinenti ai diritti umani.
Nel periodo 2004-2009 sono state presentate complessivamente 96 interrogazioni, per lo più
vertenti su alcuni paesi (Cuba, la Cina, il Nord Africa, la Turchia, ecc.) o su questioni
trasversali di diritti umani, quali l'impunità, la pena di morte e le violazioni di alcuni specifici
diritti umani.
3. Orientamenti dell'UE in materia di diritti umani
L'Unione europea ha adottato otto orientamenti nel settore del sostegno ai diritti umani: sulla
tutela degli attivisti dei diritti umani, sulla prevenzione della tortura, sulla lotta contro la pena
di morte, sulla protezione dei bambini nei conflitti armati, sui dialoghi strutturati in materia di
diritti umani con paesi terzi, sul diritto umanitario internazionale (DUI) e, recentemente, sulla
tutela dei diritti del bambino (nel 2007) e sulla violenza alle donne e alle minori (nel 2008).
Nel 2005 la sottocommissione ha organizzato uno scambio di opinioni sugli orientamenti in
materia di tutela degli attivisti dei diritti umani e un incontro con Hna Jilani, relatore speciale
dell'ONU per gli attivisti dei diritti umani.
Nel 2006 la sottocommissione ha ricevuto uno studio sull'applicazione degli orientamenti in
materia di tortura, che, nelle conclusioni, formulava diverse raccomandazioni specifiche,
rivolte alla Commissione, onde riesaminare e aumentare l'efficacia di tutti gli orientamenti sui
diritti umani. Ne sono derivati diversi miglioramenti: gli orientamenti sono stati rivisti e
aggiornati, le delegazioni e i funzionari dell'UE hanno ricevuto una formazione per un loro
efficace utilizzo, e diversi orientamenti stati tradotti in arabo, cinese, farsi e russo. Tuttavia,
rimane ancora molto da fare per migliorare ulteriormente l'applicazione degli orientamenti.

4. Dialoghi e consultazioni in materia di diritti umani
Sulla base di una raccolta di sei studi, eseguiti su richiesta della sottocommissione sui diversi
dialoghi e consultazioni sui diritti umani che l'UE sta conducendo bilateralmente (con la Cina,
la Russia, i paesi ACP, i paesi vicini, l'America Latina e l'Iran) e di un parere legale formulato
dal servizio giuridico del PE, è stata redatta una relazione1 del Parlamento europeo da parte
dell'on. Elena Valenciano Martínez-Orozco (PSE), che esprime una valutazione sul
funzionamento dei dialoghi e delle consultazioni in materia di diritti umani tra l'UE e paesi
terzi. Detta relazione ha fornito un'analisi dettagliata dei diversi tipi di dialoghi e
consultazioni sui diritti umani, quali il dialogo strutturato con la Cina, le consultazioni con la
Russia, il nuovo dialogo basato sull'accordo di partenariato e di cooperazione con
l'Uzbekistan, nonché il dialogo politico e le eventuali "consultazioni previste dall'articolo 96"
condotte con paesi dell'Africa, dei Caraibi e del Pacifico (ACP). Il documento contiene
raccomandazioni intese a migliorare detti dialoghi, in particolare rendendoli più trasparenti e
pubblici, come pure sviluppando la coerenza interistituzionale dell'UE e rafforzando il ruolo
del Parlamento europeo.
La sottocommissione ha organizzato regolari riunioni informative a porte chiuse sui
preparativi e relazioni sui risultati dei principali dialoghi, con un'attenzione particolare alla
Cina, alla Russia e all'Uzbekistan, come pure ai paesi vicini meridionali, in taluni casi anche
invitando i rappresentanti della Troika dell'UE e la presidenza della delegazione
interparlamentare interessata a uno scambio di opinioni nell'ambito delle riunioni ordinarie
della sottocommissione.
A seguito delle raccomandazioni contenute nella relazione Valenciano, si è instaurata una
nuova prassi secondo la quale i rappresentanti della Troika forniscono informazioni ai
deputati interessati, in modo informale e confidenziale, sulle tornate dei dialoghi. Tra il
2007e il 2008 si sono svolti complessivamente cinque incontri di questo tipo, concernenti i
dialoghi con la Cina, l'Unione Africana, l'Egitto, Israele e l'Uzbekistan. Questa nuova prassi
ha consentito al Parlamento di essere meglio informato e di esercitare una maggiore influenza
sui dialoghi e sulle consultazioni in materia di diritti umani. Inoltre, il segretariato veniva
regolarmente invitato a presenziare ai seminari giuridici all'epoca dei dialoghi UE-Cina e agli
incontri con le ONG in preparazione delle consultazioni con la Russia.
5. Clausole sui diritti umani
Nella prima relazione2 di iniziativa della sottocommissione DROI/AFET sulle clausole sui
diritti umani negli accordi dell'UE con paesi terzi, redatta nel 2006 dall'on. Vittorio Agnoletto,
il Parlamento ha analizzato l'effetto delle clausole sui diritti umani e sulla democrazia negli
accordi con paesi terzi e le loro inadeguatezze, formulando proposte tese a migliorare la loro
efficacia. Una delle proposte più significative è stata quella di sviluppare un sistema più
efficace per le procedure di consultazione fondate sugli articoli 9 e 96 dell'accordo di
Cotonou.

6. Sanzioni come parte integrante della politica dell'UE per i diritti umani
Nel 2008 la sottocommissione ha elaborato una relazione1 sulle sanzioni dell'UE nell'ambito
dei diritti umani (relatore: Hélène Flautre) nella quale il Parlamento esorta l'Unione europea a
migliorare il suo ricorso alle sanzioni come strumento di politica estera, sottolineando
l'esigenza di una maggiore coerenza nel loro utilizzo, anche tramite una maggiore accuratezza
nell'analisi e nella valutazione del loro impatto, e ad aumentarne l'efficacia, per esempio
analizzando approfonditamente ogni singola situazione prima dell'adozione di sanzioni e
ponendo criteri chiari e specifici come condizioni per la loro revoca. Oltre alle relazioni sulle
clausole e sui dialoghi in materia di diritti umani, la suddetta relazione costituisce un elemento
fondamentale del trilogo che fornisce una valutazione dei principali strumenti della politica
estera dell'UE nell'ambito dei diritti umani e una base per un futuro esame da parte del
Parlamento europeo degli sviluppi raggiunti in questo contesto.
Durante un dibattito in seno alla sottocommissione all'inizio del 2009, la Commissione ha
dichiarato che i membri avrebbero ricevuto informazioni pertinenti riguardo alla recente
imposizione o estensione di sanzioni. Le altre istituzioni hanno ritenuto che l'utilità di una rete
di esperti indipendenti richiedesse un esame più approfondito. La Commissione ha
annunciato, per quanto riguarda le disposizioni in materia di sanzioni (inserimento e
cancellazione dalle liste nere), che avrebbe presentato proposte o intrapreso azioni, se del
caso, per uniformare le procedure di inserimento nelle liste alla pertinente giurisprudenza.
7. Strumento europeo per la democrazia e i diritti dell'uomo (EIDHR) e controllo
dei bilanci
Il Parlamento europeo, tramite il gruppo di lavoro della sottocommissione sull'EIDHR
(Strumento europeo per la democrazia e i diritti dell'uomo), ha usato i suoi poteri di bilancio
per aumentare in modo sostanziale le risorse destinate a programmi attinenti alla democrazia e
ai diritti umani, che saranno finanziati da un capitolo del bilancio a parte, creato su iniziativa
del Parlamento, l' Iniziativa europea per la democrazia e i diritti dell'uomo.
Durante i negoziati sui nuovi strumenti finanziari per l'assistenza esterna, il Parlamento
europeo ha rilevato la necessità di un regolamento distinto per l'azione dell'UE in materia di
democrazia e diritti umani in quanto una delle principali priorità per garantire visibilità e
flessibilità e ha sottolineato l'importanza di uno strumento che possa funzionare a prescindere
dal consenso delle autorità dei paesi terzi. Nell'autunno 2006 si sono svolti intensi e proficui
negoziati interistituzionali, con la presidente, Hélène Flautre (Verts/ALE) e l'on. Edward
McMillan-Scott (PPE-DE) in veste di correlatori per il Parlamento europeo. Tali negoziati
hanno portato all'adozione delle nuove misure ad hoc, che assicurano uno specifico sostegno
agli attivisti per i diritti umani e la possibilità di sostenere organizzazioni della società civile
non registrate.

Attraverso il processo di controllo democratico del nuovo Strumento europeo per la
democrazia e i diritti dell'uomo, infine istituito il 20 dicembre 20061, il PE sta partecipando
attivamente alla supervisione dell'attuazione di questo strumento. Un gruppo di lavoro
specifico è stato costituito a questo scopo in seno alla sottocommissione. Tra il 2007 e il 2009,
il gruppo di lavoro si è riunito sei volte.
Le risorse di bilancio destinate all'EIDHR, che per il periodo 2007-2013 ammontano a 1 104
milioni di euro, sostengono il settore della cooperazione volto a rafforzare il rispetto dei diritti
umani e delle libertà fondamentali, attraverso la promozione e il consolidamento della
democrazia e delle riforme democratiche nei paesi terzi, il sostegno e la solidarietà verso gli
attivisti dei diritti umani e le persone che subiscono repressione e abusi e il potenziamento
della società civile coinvolta attivamente nell'ambito dei diritti umani e della promozione
della democrazia; il sostegno e il rafforzamento del quadro internazionale e regionale in
quest'ambito; il rafforzamento della fiducia nei processi elettorali, potenziandone l'affidabilità,
in particolare mediante missioni di osservazione elettorale e attraverso il sostegno delle
organizzazioni locali della società civile coinvolte in tali processi.
8. Integrazione dei diritti dell'uomo
Il Parlamento europeo, nel suo complesso, attinge al lavoro della sottocommissione per
elaborare le proprie posizioni sulla promozione dei diritti umani nei paesi terzi, in
collegamento sia con il lavoro dell'ONU che con la ratifica di nuovi accordi internazionali.
Inoltre, la sottocommissione contribuisce all'integrazione della politica dell'UE in materia di
diritti umani e promozione della democrazia all'interno dei vari organi del Parlamento, quali
le delegazioni interparlamentari, le commissioni parlamentari miste e le assemblee
parlamentari multilaterali.
Allo scopo, la sottocommissione ha proceduto a invitare sistematicamente alle proprie
riunioni le presidenze delle diverse delegazioni che hanno rapporti con i paesi oggetto di
analisi, assieme ai diversi relatori impegnati su quei paesi specifici.
Nel luglio 2005 il presidente, Hélène Flautre, ha incontrato i membri della Conferenza dei
presidenti di delegazione. Lo scopo dell'incontro era presentare ai presidenti delle delegazioni
del PE alcuni esempi delle migliori pratiche di attuazione della politica dei diritti umani
dell'UE, e più specificatamente degli orientamenti dell'UE in materia di diritti umani. Si è
convenuto di proporre ai membri un prontuario delle migliori pratiche per attuare e dare
seguito alla politica dell'UE in materia di promozione dei diritti umani e della democrazia
durante le loro visite a paesi terzi. Ciò ha portato la Conferenza dei presidenti, nel gennaio
2006, ad adottare e avallare gli "Orientamenti specifici per l’azione dei membri del PE a
favore dei diritti dell’uomo nell'ambito delle missioni nei paesi terzi".
9. Casi di violazione dei diritti umani di singoli individui
Durante la sesta legislatura il Parlamento ha sollevato numerosi casi di singoli individui
incarcerati, molestati o minacciati, tra cui figurano prigionieri politici, prigionieri di

coscienza, giornalisti, dissidenti cibernetici, scienziati, sindacalisti e attivisti per i diritti
umani.
Tra i casi di maggiore risonanza figurano quello delle infermiere bulgare e del medico
palestinese in Libia, l'omicidio di Anna Politkovskaya in Russia, gli arresti domiciliari del
premio Sacharov Aung San Suu Kyi in Birmania, l'incarcerazione del dottor Ayman Nour in
Egitto e di Hu Jia in Cina. L'elenco completo dei casi è riportato all'allegato I della relazione
annuale sui diritti umani che il Parlamento approva ogni anno.
I casi sono stati sollevati o tramite una lettera alle autorità, firmata dal Presidente del
Parlamento, dai presidenti dell'AFET o della DROI e/o dal presidente della delegazione del
PE coinvolta, oppure in sede di discussione alla riunione della sottocommissione, o ancora
sono stati inseriti in risoluzioni d'urgenza sui diritti umani (cfr. punto seguente). In taluni casi,
sono state condotte iniziative riservate da parte del Presidente e del suo Gabinetto.
Questo lavoro si avvale della cooperazione mirata tra l'Unità diritti umani, il funzionario della
Commissione e la sua delegazione nel paese interessato, come pure i singoli deputati e, se del
caso, il servizio giuridico nonché, in alcune occasioni, la Presidenza del Parlamento europeo.
Una quantità notevole di informazioni proviene anche dalle organizzazioni non governative.
Procedure principali
1. Risoluzioni d'urgenza
Allegato IX
Un importante aspetto delle attività del Parlamento è costituito dalle risoluzioni parlamentari
che riguardano violazioni dei diritti umani in paesi specifici e, segnatamente, singoli casi che
vengono affrontati nelle discussioni mensili in Aula su tematiche urgenti. Il Consiglio, la
Commissione e i governi dei paesi interessati vengono invitati ad agire. Le reazioni dei
governi interessati fanno ritenere che essi siano sensibili alle critiche del Parlamento europeo.
L'Unità diritti umani fornisce materiale ai consulenti per i diritti umani dei gruppi politici, che
sono responsabili dell'elaborazione di risoluzioni su argomenti scelti dalla Conferenza dei
presidenti (cfr. la procedura d'urgenza, articolo 115 del regolamento).
Durante i cinque anni del periodo di riferimento, il Parlamento ha approvato più di 250
risoluzioni su questioni relative ai diritti umani.
Gli argomenti per una procedura d'urgenza possono emergere da un'audizione presso la
sottocommissione per i diritti umani, così come possono avere seguito in quel contesto,
oppure provenire da una segnalazione apposita da parte di una delegazione parlamentare. Le
problematiche sollevate secondo questa prassi possono essere inoltre affrontate in riunioni
interparlamentari o nelle riunioni che si svolgono tra il Presidente e gli ambasciatori.
Tra il 2004 e il 2009, la maggior parte delle risoluzioni del Parlamento europeo concernenti i

La valutazione d'impatto eseguita su richiesta della sottocommissione fornisce un'analisi
approfondita dell'impatto di queste risoluzioni sui paesi terzi responsabili di violazioni dei
diritti umani, sui singoli individui e sui gruppi menzionati, nonché sulle norme e sulle
clausole. Sulla base delle raccomandazioni contenute nella valutazione, la sottocommissione
ha monitorato il seguito dato a tali risoluzioni, registrando le reazioni dei governi dei paesi
terzi e le azioni da parte delle istituzioni comunitarie.
Si sono svolte, inoltre, diverse discussioni con la Commissione e il Consiglio che non sono
sfociate nell'approvazione di risoluzioni. La preparazione di vertici tra l'UE e i paesi terzi
fornisce regolarmente occasioni per l'approvazione di risoluzioni che fanno anche riferimento
a questioni di diritti umani. I vertici con la Russia e la Cina, per esempio, hanno fornito al
Parlamento l'opportunità di esprimere opinioni molto marcate sulle questioni relative ai diritti
umani in Cecenia e in Tibet.
2. Relazioni

Tra il 2004 e il 2009 la sottocommissione ha elaborato undici relazioni del Parlamento
europeo, che sono state discusse e infine approvate dalla commissione per gli affari esteri.
Con l'approvazione finale in Aula, le relazioni sono diventate risoluzioni del Parlamento
europeo, vale a dire posizioni dell'intera assemblea parlamentare. Oltre alle cinque relazioni
annuali sui diritti umani e alla relazione sul Consiglio per i diritti dell'uomo (relatore: l'on.
Andrikiené), altre relazioni che hanno costituito il nucleo centrale delle attività della
sottocommissione nel periodo 2004-2009 hanno riguardato le clausole sui diritti umani
(relatore: l'on. Agnoletto), i dialoghi in materia di diritti umani (relatore: l'on. Valenciano) e le
sanzioni (relatore: l'on. Flautre).
Relazione annuale
Quasi in contemporanea con la pubblicazione della relazione annuale dell'UE sui diritti umani
da parte del Consiglio, alla quale la sottocommissione contribuisce notevolmente con le
proprie attività, il Parlamento europeo avvia l'elaborazione della propria relazione annuale
sulla situazione dei diritti umani nel mondo e sulla politica dell'UE in materia di diritti umani.
Nel 2005 la relazione è stata redatta da Simon Coveney (PPE-DE), e la risoluzione sulla
relazione annuale del Consiglio del 2004 ha fornito una visione d'insieme delle situazioni più
preoccupanti in materia di diritti umani nei singoli paesi raggruppati per regioni, esaminando

Sintesi delle attività durante la sesta legislatura, 2004-2009
più approfonditamente nove questioni tematiche specifiche. Le questioni in oggetto erano: i
diritti umani e la lotta al terrorismo, i diritti dell'infanzia, l'impatto dei conflitti sulle donne e
sui bambini, la pena di morte, il traffico di esseri umani e di organi, la prostituzione minorile e
il lavoro minorile, il ruolo delle multinazionali nell'ambito dei diritti umani, l'impunità e il
ruolo del Tribunale penale internazionale.
Sulla base di un'analisi delle relazioni annuali del Parlamento adottate negli ultimi dieci anni,
e cogliendo il suggerimento contenuto nella valutazione d'impatto di trasformare queste
relazioni in un vero e proprio strumento atto a valutare l'attuazione delle politiche e iniziative
dell'UE in materia di diritti umani e democrazia, nel 2006 il relatore Richard Howitt ha
introdotto un nuovo approccio alla relazione annuale, trasformandola in un'analisi del lavoro
dell'Unione europea per i diritti umani in tutte le sue forme, con proposte per aumentarne
l'efficacia. Le tematiche discusse comprendevano le attività dell'UE nelle organizzazioni
internazionali, l'integrazione dei diritti umani in altri settori politici, compresi gli scambi e i
dialoghi dell'UE con i paesi terzi in materia di diritti umani.
Simon Coveney (PPE-DE), che ha seguito l'approccio trasversale dell'on. Howitt, è stato
nuovamente il relatore della relazione annuale nel 2007. Nel 2008 la relazione è stata
elaborata dall'on. Marco Cappato (ALDE) e, nel 2009, dall'on. Raimond Obiols i Germa
(PSE).
Pareri
Allegato IV
Dal 2004 al 2009, oltre alle proprie relazioni, la sottocommissione ha elaborato e trasmesso le
proprie posizioni sotto forma di pareri sulle relazioni parlamentari di altre commissioni.
Sette, dei dieci pareri, erano indirizzati alla commissione per le libertà civili, la giustizia e gli
affari interni (LIBE). I rimanenti tre pareri sono stati trasmessi alla commissione per lo
sviluppo (DEVE), alla commissione per gli affari costituzionali (AFCO) e alla commissione
per il commercio internazionale (INTA).
3. Audizioni e altre attività

Nel periodo di riferimento, la sottocommissione per i diritti dell'uomo ha organizzato più di
quaranta tra scambi di opinioni e audizioni su tematiche in materia di diritti umani. Le
audizioni prendevano in esame la situazione dei diritti umani in uno specifico paese o in una
specifica regione geografica, oppure una tematica trasversale dei diritti umani quale la pena di
morte, la protezione degli attivisti dei diritti umani, la tortura, i diritti dell'infanzia, la giustizia
transitoria, la responsabilità sociale delle imprese e il Tribunale penale internazionale.
Un'audizione annuale è stata dedicata alla situazione dei diritti umani in Turchia e un'altra era
destinata alla politica di vicinato dell'UE, con particolare attenzione all'attuazione degli aspetti
relativi ai diritti umani nei piani d'azione nazionali dei un paesi orientali nell'ambito della
PEV (la Moldova nel 2005, l'Azerbijan nel 2007, l'Armenia nel 2008) e di uno o due paesi
meridionali della PEV (il Marocco nel 2005, l'Egitto nel 2006, Israele nel 2006, la Giordania
nel 2007, la Tunisia nel 2008).

Le questioni di diritti umani in Cina, Russia, Uzbekistan e Asia centrale sono apparse
regolarmente all'ordine del giorno delle riunioni della sottocommissione. Inoltre, è stata
dibattuta la situazione dei diritti umani nei seguenti paesi: Cuba, Siria, Iraq, Iran, Cambogia,
Laos, Vietnam, Filippine, Pakistan, Bangladesh e Nepal, come pure il problema dei
femminicidi in Messico e in Guatemala e quello della tutela delle minoranze in Vojvodina,
Serbia.
Nel 2004 e 2005 i più significativi scambi di opinioni in seno alla sottocommissione hanno
avuto per oggetto la relazione dell'on. McMillan-Scott sull'EIDHR, la valutazione delle
attività della Commissione in materia di diritti umani, l'impatto dei vari strumenti dell'UE e il
documento programmatico della Commissione sull'EIDHR per il biennio 2005-2006.
Poiché il 2005 è stato l'anno del Mediterraneo, il decennale del processo di Barcellona e
l'anno della prima sessione plenaria dell'Assemblea parlamentare euromediterranea, la
sottocommissione ha dedicato un'audizione pubblica alle sparizioni forzate nella regione del
Mediterraneo (in particolare in Algeria) e un'altra alla libertà di espressione e lo sviluppo di
democrazie parlamentari nella regione euromediterranea.
Oltre a svolgere le sue audizioni pubbliche ordinarie, la sottocommissione ha partecipato a
diverse importanti manifestazioni di sensibilizzazione nell'ambito dei diritti umani.
Nel Marzo 2007 le conclusioni dell'autorevole studio dal titolo "Oltre l'attivismo - Impatto
delle risoluzioni e delle altre attività del Parlamento europeo nell'ambito dei diritti umani
all'esterno dell'Unione europea", richiesto dalla sottocommissione e svolto dal Centro
interuniversitario europeo di Venezia, sono state presentate sotto forma di un seminario, che
ha visto la partecipazione del Presidente del Parlamento europeo.
Il sessantesimo anniversario della dichiarazione universale dei diritti dell'uomo è stato
commemorato quale evento di portata fondamentale nella sede del Parlamento europeo, in
collaborazione con le Nazioni Unite e con la Commissione, con un'importante conferenza alla
quale hanno partecipato personalità di alto livello e attivisti dei diritti umani di tutto il mondo.
Oltre all'organizzazione della sessione plenaria annuale sui diritti umani (settimana dedicata a
Sacharov) a dicembre a Strasburgo, l'Unità diritti umani ha coordinato attivamente
l'organizzazione della conferenza dal titolo "Vent'anni di supporto e difesa dei diritti umani: i
vincitori del premio Sacharov raccontano la propria storia", in occasione del ventennale del
premio Sacharov nel dicembre 2008 (per ulteriori dettagli, cfr. la sezione "Premio Sacharov").
Durante la conferenza il Presidente del Parlamento, la sig.ra Elena Bonner, vedova di Andrei
Sacharov, e i vincitori del premio presenti hanno convenuto di istituire la rete Sacharov, allo
scopo di sostenersi vicendevolmente nelle proprie attività a favore dei diritti umani.
4. Cooperazione con altre commissioni
Commissione per le libertà civili, la giustizia e gli affari interni (LIBE)
Le questioni relative ai diritti umani nell'UE rientrano nella sfera di competenza della
commissione per le libertà civili, la giustizia e gli affari interni (LIBE), che esamina la
situazione per quanto riguarda il rispetto dei diritti fondamentali nell'UE.

Sintesi delle attività durante la sesta legislatura, 2004-2009
La sottocommissione ha intrattenuto rapporti di stretta collaborazione con questa
commissione per seguire gli effetti esterni delle politiche interne, soprattutto per quanto
riguarda le questioni relative all'asilo e alla migrazione e gli aspetti attinenti ai diritti umani
del traffico di esseri umani e di organi. Nel 2007, sulla base del lavoro svolto da una
commissione parlamentare temporanea, il Parlamento ha approvato la relazione Fava, che
esamina e condanna con decisione le consegne straordinarie di cittadini dell'UE e di paesi
terzi, trasportati in centri di detenzione segreti e torturati. A seguito della questione delle
deportazioni illegali da parte della CIA, la commissione per le libertà civili ha organizzato una
riunione nel maggio 2007 con il Sig. Chertoff, ministro della Sicurezza interna degli USA, e
con la presidenza tedesca, allo scopo di ottenere maggiori informazioni su tali questioni. La
sottocommissione per i diritti dell'uomo era rappresentata in quell'occasione da Sarah
Ludford. Un'importante audizione congiunta si è svolta al riguardo nel luglio 2006 alla
presenza di Dick Marty dell'Assemblea parlamentare del Consiglio d'Europa, sulla sua
seconda relazione sui voli segreti e sulle consegne straordinarie della CIA.
Diverse discussioni in seno alla sottocommissione sono state imperniate sulla promozione e
sulla protezione dei diritti fondamentali, in relazione all'istituzione dell'Agenzia dell’Unione
europea per i diritti fondamentali, a seguito della quale si è svolto un dibattito con il direttore
dell'Agenzia nel 2008.
Commissione per lo sviluppo (DEVE)
Oltre alla sottocommissione per i diritti dell'uomo, anche un gruppo di lavoro all'interno della
commissione per lo sviluppo svolge riunioni periodiche sui diritti umani nei paesi in via di
sviluppo oppure su argomenti specifici, quali i soldati bambini o i bambini schiavi, sia con
ONG che si occupano di diritti umani che con esponenti dei governi coinvolti, ultimamente
riguardo all'Uganda settentrionale, e su altri argomenti ancor più specifici come la situazione
dei Dalit in India. In caso di problemi comuni, i due organi organizzano riunioni congiunte o
audizioni pubbliche: ad esempio nel giugno 2007, in una di queste audizioni, si è esaminata la
situazione dei diritti umani in Etiopia a due anni dalle elezioni avvenute sotto la sorveglianza
dell'UE.
Un'altra riunione speciale congiunta è stata organizzata nel giugno 2007 dalla conferenza dei
presidenti dei Gruppi politici del Parlamento, al fine esternare le preoccupazioni del
Parlamento sulla situazione di conflitto che si protrae in Darfur (Sudan). In quell'occasione,
l'arcivescovo Desmond Tutu e il premio Nobel per la pace Jody Williams hanno parlato in
Parlamento ed hanno invitato i suoi membri a prendere iniziative concrete e ad agire allo
scopo di porre fine al conflitto armato e alla sofferenza della popolazione del Darfur. A
seguito di tale incontro, su iniziativa della commissione per lo sviluppo, il Parlamento
europeo ha adottato, il 12 luglio 2007, una risoluzione nella quale ha espresso le sue
preoccupazioni sulla situazione dei diritti umani nel Darfur. Gli Stati membri, il Consiglio e la
Commissione sono stati invitati ad assumersi le proprie responsabilità e a compiere ogni
sforzo possibile per fornire una reale protezione alle popolazioni colpite dalla crisi.
Delegazioni interparlamentari
Anche le delegazioni interparlamentari del Parlamento discutono regolarmente questioni

relative ai diritti umani con esponenti dei parlamenti di tutto il mondo. La sottocommissione,
oltre a elaborare orientamenti per l'integrazione dei diritti umani a beneficio di tutte le
delegazioni interparlamentari del Parlamento in paesi terzi, ha invitato le presidenze delle
delegazioni alle sue riunioni, affinché potessero partecipare alle discussioni che vertevano sul
paese di competenza.
Assemblea parlamentare paritetica ACP-UE
Il principale forum di dialogo politico fra il PE e i parlamentari dei paesi dell'Africa, dei
Caraibi e del Pacifico è l'Assemblea parlamentare paritetica ACP-UE. I diritti umani
costituiscono regolarmente un punto all'ordine del giorno nelle riunioni del suo Ufficio di
presidenza, come pure della sua commissione per gli affari politici. Nel periodo di
riferimento, con l'assistenza dell'Unità diritti umani, si sono svolte discussioni, fra le altre,
sulla situazione in Zimbabwe, Repubblica democratica del Congo, Corno d'Africa, Darfur
(Sudan), Fiji e Mauritania e sono state elaborate relazioni sulla migrazione illegale, sulla
libertà di associazione e sulla pena di morte nell'ambito del partenariato tra i paesi ACP e
l'UE.
Assemblea parlamentare euromediterranea (APEM)
L'assemblea parlamentare euromediterranea fornisce opportunità di dialogo parlamentare con
i paesi mediterranei su questioni di diritti umani e di democrazia. In tale contesto si è svolta
una audizione sulla libertà di espressione e sullo sviluppo della democrazia parlamentare nella
regione euromediterranea. Nel 2007, la sessione plenaria si è tenuta in Tunisia ed ha rivolto
particolare attenzione al tema "Dialogo fra culture". Le varie commissioni dell'assemblea si
sono riunite più di frequente e hanno affrontato questioni come il conflitto arabo-israeliano, il
terrorismo, la riduzione della povertà e il miglioramento della situazione delle donne nei paesi
euromediterranei. La commissione per gli affari politici, la sicurezza e i diritti umani ha
istituito la prassi di inserire un punto fisso sui diritti umani in ogni ordine del giorno.
Assemblea parlamentare euro-latinoamericana
La sottocommissione ha inoltre collaborato con l'Assemblea parlamentare eurolatinoamericana, che offre opportunità di dialogo parlamentare con paesi dell'America Latina
su questioni di diritti umani e di democrazia.
Parlamenti nazionali dell'Unione europea
Nel giugno 2008, le commissioni parlamentari per i diritti umani degli Stati membri
dell'Unione europea hanno tenuto una riunione al Parlamento europeo, nel quadro di una
riunione della sottocommissione per i diritti dell'uomo, riservando una particolare attenzione
alla lotta contro la tortura come priorità fondamentale dell'UE nell'ambito della Giornata
internazionale a sostegno delle vittime di tortura. Alla presenza di Manfred Nowak, il relatore
speciale dell'ONU sulla tortura, i membri partecipanti hanno approvato una dichiarazione su
questo tema, la quale tra l'altro dichiara che gli Stati membri dovranno sostenere il
finanziamento di centri di riabilitazione per le vittime di torture e sottoscrivere il Protocollo
facoltativo della Convenzione contro la tortura (OPCAT).
Attività della presidenza DROI
Come attività supplementare tesa a rafforzare il lavoro della sottocommissione nel settore dei
diritti umani, il presidente, Hélène Flautre, ha svolto regolarmente riunioni bilaterali e
riservate con attivisti dei diritti umani, ambasciatori ed esponenti della società civile, alle

quali erano invitati anche i membri dell'Ufficio di presidenza allargato e rappresentanti dei
gruppi politici e dell'Unità diritti umani. Tali riunioni erano volte allo scambio di informazioni
e a dare sostegno a tutti coloro che si battono per i diritti umani.
5. Premio Sacharov
Sin dal 1988, il Parlamento europeo ha assegnato il premio annuale per la libertà di pensiero,
così intitolato in omaggio ad Andrei Sacharov, per onorare persone o organizzazioni che si
sono battute per i diritti umani e le libertà fondamentali, lottando contro oppressioni e
ingiustizie. Il Parlamento ha insignito del premio Sacharov 2004 per la libertà di pensiero
l'Associazione dei giornalisti bielorussi.
Momento particolarmente significativo del 2004 è stata la cerimonia speciale per la vincitrice
del premio Sacharov nel 1995, Leyla Zana, già deputato curdo. Quando il Parlamento le ha
assegnato il premio, Leyla Zana era in carcere già da un anno e non lo aveva potuto ritirare
personalmente. Dopo 10 anni trascorsi in carcere, è stata finalmente rilasciata il 9 giugno
2004 e ha potuto parlare alla sessione plenaria del Parlamento in occasione di questa
particolare cerimonia, che si è svolta il 14 ottobre 2004.
Nel 2005 il premio è stato assegnato alle Donne in bianco, come riconoscimento della loro
azione a favore dei prigionieri politici a Cuba, a Hauwa Ibrahim, per il suo lavoro di avvocato
in difesa delle donne e dei bambini accusati secondo la legge Sharia in Nigeria, e
all'associazione Reporter senza frontiere, in virtù della sua lotta per la libertà di stampa nel
mondo.
Per amplificare l'impatto generale del premio Sacharov, accogliendo il suggerimento della
valutazione d'impatto, nel 2006 il Parlamento ha modificato lo statuto della procedura di
assegnazione del premio. L'Unità diritti umani ha partecipato attivamente al processo. Una
delle principali migliorie introdotte è stata quella di aver reso più trasparente la nomina dei
candidati, che può essere presentata non solo da gruppi politici, ma anche da almeno 40
membri del Parlamento. Le nuove disposizioni ammettono un solo vincitore, la cui
designazione a ballottaggio segreto è stata assegnata congiuntamente alla commissione per lo
sviluppo e alla commissione per gli affari esteri.
L'anno seguente, nel 2006, il premio è stato assegnato ad Aliaksandr Milinkevich, per la sua
lotta per i diritti della democrazia e per le libertà politiche in Bielorussia. Aliaksandr
Milinkevich ha condotto dimostrazioni di massa contro le scorrette elezioni presidenziali
tenutesi nel marzo 2006 ed è stato detenuto varie volte per aver incoraggiato la popolazione a
continuare a rivendicare il proprio diritto alla libertà di espressione e di riunione.
Nel 2007 è stato premiato Salih Mahmoud Osman, un avvocato sudanese, per la sua lotta a
sostegno delle vittime dei massacri nel Darfur.
La prima cerimonia per il conferimento del premio è stata, purtroppo, poco pubblicizzata. Nel

2008 essa ha avuto maggiore risonanza, non solo per la maggiore copertura dei mezzi
d'informazione, che nell'era del digitale assicurano un'informazione continua, ma anche
perché ricorreva il ventennale del premio. Per l'occasione, il Presidente del Parlamento ha
invitato tutti i precedenti vincitori ancora in vita, gran parte dei quali hanno partecipato alla
sessione plenaria del 17 dicembre 2008. Purtroppo, tuttavia, alcuni di loro non hanno potuto
partecipare, come le Donne in bianco e Oswaldo Paya, di Cuba, cui è stato negato il permesso
di uscire dal paese, la birmana Aung San Suu Kyi, premiata nel 1990, condannata agli arresti
domiciliari, e Hu Jia, premiato nel 2008, incarcerato dalle autorità cinesi.
Il 26 novembre 2007 Hu Jia aveva parlato ai membri del Parlamento europeo collegandosi in
videoconferenza durante un'audizione pubblica della sottocommissione per i diritti dell'uomo,
dedicata alla situazione in Cina alla vigilia dei Giochi olimpici del 2008. Come diretta
conseguenza del suo discorso, è stato arrestato con l'accusa di "avere incitato alla sovversione
del potere dello stato" e condannato a tre anni e mezzo di carcere. Durante la cerimonia di
premiazione per il 2008 in suo onore, il 17 dicembre 2008, è stato trasmesso un
videomessaggio con un toccante discorso a suo nome, registrato da sua moglie sul computer
di casa.
6. Visite delle delegazioni

La sottocommissione ha la possibilità di organizzare missioni per le proprie delegazioni.
Inoltre, i membri della sottocommissione prendono parte a delegazioni ad hoc del Parlamento
europeo.
Durante la sesta legislatura, i membri della sottocommissione hanno partecipato in sede di
delegazione a numerosi eventi, quali il Forum UE-ONG sui diritti umani, il terzo congresso
mondiale contro la pena di morte e conferenze multilaterali organizzate dall'OSCE. Inoltre, la
sottocommissione ha inviato ogni anno una delegazione in Turchia. Un'altra delegazione ha
effettuato una visita in Croazia nel 2007.
Prendendo parte a missioni di osservazione elettorale, i membri della sottocommissione
contribuiscono ulteriormente al rafforzamento dei diritti umani e della democrazia nei paesi
terzi.
Consiglio delle Nazioni Unite per i diritti dell'uomo (HRC)
Il Consiglio delle Nazioni Unite per i diritti dell'uomo di Ginevra è un importante organismo
per la cooperazione nel settore dei diritti umani, la cui creazione è stata seguita con grande
interesse e grandi aspettative dalla sottocommissione: una delegazione del Parlamento
europeo si è recata una prima volta a Ginevra nel 2004 e in seguito una volta all'anno, per la
sessione principale, o due volte l'anno quando gli argomenti di discussione erano di
particolare importanza. I membri della delegazione incontravano solitamente la presidenza
dell'UE e degli Stati membri, altri ambasciatori, relatori speciali e organizzazioni non
governative. Il Parlamento ha ribadito con coerenza il suo sostegno a favore di un Consiglio
forte e capace di affrontare con efficacia le violazioni dei diritti umani nel mondo in un
momento in cui i vari regolamenti procedurali e i metodi di lavoro sono in corso di
definizione. Nel 2007 i membri della sottocommissione DROI hanno inoltre assistito, come

parte di una missione conoscitiva, a una sessione della Terza commissione dell'Assemblea
generale delle Nazioni Unite.
Cooperazione con le Nazioni Unite
Allegato VI
In preparazione della visita della delegazione al Consiglio delle Nazioni Unite, la
sottocommissione ha organizzato regolari scambi di opinioni con il suo presidente in carica e
con altri principali funzionari, come i relatori speciali delle Nazioni Unite. Lo stretto dialogo
intrattenuto con il presidente dell'HRC verteva in particolare sul riesame periodico universale,
sui criteri di adesione e sui mandati dei relatori speciali.
Nel 2005 ha avuto luogo uno scambio di opinioni con l'allora Alto commissario delle Nazioni
Unite per i diritti dell'uomo, Louise Arbour. Il suo successore, Navanethem Pillay, ha parlato
ai membri della sottocommissione nel 2008, in occasione della conferenza per il sessantesimo
anniversario della Dichiarazione universale dei diritti dell'uomo.
Nella primavera 2008, membri della sottocommissione hanno preso parte a una delegazione
ad hoc del Parlamento in visita al Forum permanente sulle questioni indigene delle Nazioni
Unite, dove ha preso la parola l'on. Flautre. La presidenza del Forum ha a sua volta visitato il
Parlamento europeo e partecipato a un'audizione della sottocommissione.
Relazioni con il Consiglio d’Europa
La sottocommissione ha anche intrattenuto un dialogo regolare con l'assemblea parlamentare
dell'OSCE e con il Consiglio d'Europa. In questo contesto, vi è una costante collaborazione in
atto con l'ufficio del commissario per i diritti umani del Consiglio d'Europa.
7. Studi
Allegato VIII
Durante il suo primo anno di attività, la sottocommissione, in stretta cooperazione con l'Unità
tematica della DG Politiche esterne dell'Unione, ha utilizzato il budget destinato alle
consulenze per commissionare più di quaranta studi esterni su diversi argomenti. Gli studi
hanno fornito una base teorica sulla quale elaborare una relazione parlamentare (per esempio
sulle clausole sui diritti umani, sui dialoghi e sulle sanzioni) o da utilizzare per le visite delle
delegazioni, o ancora, hanno indicato argomenti per ulteriori discussioni. Nel 2004 la
sottocommissione ha ricevuto uno studio, per il quale aveva fatto speciale richiesta, sugli
strumenti finanziari a disposizione dell'Unione europea per sostenere le sue attività in materia
di diritti umani in paesi terzi, con particolare riferimento all'Iniziativa europea per la
democrazia e i diritti umani.
Nel periodo di riferimento sono stati commissionati cinque studi sulla pena di morte (nella
regione dei Grandi Laghi, nelle Filippine, a Singapore, negli USA e nel sistema
interamericano) e sette studi sui dialoghi e le consultazioni in materia di diritti umani (con
l'Iran, la Cina, la Russia, l'America centrale, nell'ambito della PEV e degli accordi di Cotonou,
nonché una relazione sintetica). E' stato elaborato uno studio importante, che ha implicato la

visita di numerosi paesi e numerose indagini da parte dell'esperto incaricato, relativo
all'attuazione degli orientamenti dell'UE in materia di tortura e altri trattamenti o pene crudeli,
inumane o degradanti. Questo documento è stato presentato al Gruppo "Diritti umani" del
Consiglio (COHOM) e ha dato l'impulso a sforzi concreti volti a migliorare l'attuazione degli
orientamenti.
8. Piattaforma di dialogo con la società civile
Fra i soggetti più importanti che seguono attivamente il lavoro della sottocommissione
figurano le organizzazioni non governative, internazionali e con base a Bruxelles, e i
rappresentanti della società civile. Già alla sua prima riunione, dopo la sua costituzione nel
luglio 2004, la sottocommissione ha intrattenuto uno scambio di opinioni con il responsabile
dell'ufficio europeo di Amnesty International, che rappresentava la rete delle ONG impegnate
per i diritti umani e la democrazia (HRDN) e ha presentato due documenti di riflessione sulle
priorità delle ONG per la politica dei diritti umani dell'Unione europea. Negli anni seguenti, la
sottocommissione ha ospitato numerosi scambi di opinioni con la suddetta rete ed ha invitato i
suoi esponenti a quasi tutte le sue riunioni, affinché esprimessero le loro posizioni e
prendessero parte al dibattito insieme ai membri. Alla fine della sesta legislatura, nel 2008,
l'HRDN ha pubblicato un manifesto che formula raccomandazioni per la settima legislatura.
9. L'Unità diritti umani
Questa unità orizzontale all'interno della Direzione generale per le relazioni esterne del
Parlamento europeo è attualmente diretta da Geoffrey Harris e comprende sei amministratori,
un assistente, quattro segretari e, occasionalmente, diversi tirocinanti interni ed esterni. Suo
compito è contribuire a tutte le attività della sottocommissione per i diritti dell'uomo e dare
supporto ai vari altri organi, unità e attori all'interno del Parlamento europeo, quali il
Gabinetto del Presidente, le delegazioni interparlamentari e le altre commissioni parlamentari,
nel settore dei diritti umani, oltre ad assicurare il coordinamento delle loro attività in questo
settore (le questioni relative ai diritti umani e alla promozione dei valori democratici, alla
buona governance e alla tutela delle minoranze all'esterno dell'Unione europea).
L'Unità fornisce supporto anche alle Assemblee parlamentari Euromediterranea, EuroMed,
EuroLat, paritetica ACP-EU, funge da tramite per i servizi pertinenti del Consiglio (compresa
la presidenza) e della Commissione (quali la DG Relex, AidCo, DEV) e promuove la
cooperazione e lo scambio di informazioni con organi europei, internazionali e regionali che
si occupano di diritti umani, in special modo quelli del Consiglio d'Europa, delle Nazioni
Unite, dell'OSCE e dell'Unione africana. Mantiene, inoltre, contatti e scambi di informazioni
con le ONG, gli attivisti dei diritti umani e le ambasciate.
L'Unità organizza le riunioni e le audizioni della sottocommissione, prepara e accompagna le
delegazioni in visita ai paesi terzi e gestisce la corrispondenza del Presidente e del suo Ufficio
per le questioni attinenti ai diritti umani.

1. Report on the Annual Report on Human Rights in the World 2008 and the European
Union's policy on the matter (2008/2336 (INI)); rapporteur: Raimon Obiols I Germa (PSE,

The report considers that better information should be provided for the assessment of previous
policies and that guidelines should be proposed to modify the general approach as well as to
adjust the policy priorities on a country-by-country basis, with a view to the adoption of a
Country Strategy on human rights or a human rights chapter in the Country Strategy Papers;
calls on the Council and the Commission to develop specific quantifiable indices and
benchmarks in order to measure the effectiveness of its human rights policies; calls on the EU
Member States to ratify the 1990 International Convention on the Protection of the Rights of
All Migrant Workers and Members of their Families, which none of the Member States has
ratified, and calls for prompt ratification of the United Nations Convention on the Rights of
Persons with Disabilities by the European Community and its Member States; calls on the EU
Presidencies to mention the status of the ICC cooperation in all summits with third countries;
welcomes the new priority status to women's issues in the context of the EU's action in the
field of human rights, stressing, in particular, the need to tackle the tragic phenomena of
violence against women and femicide; welcomes the ratifications of the Rome Statute by
Madagascar, Cook Islands and Suriname; demands the Czech Republic, (the only remaining
European Union Member State) to ratify the Rome Statute without further delay; urges
Romania to rescind its Bilateral Immunity Agreement with the United States.
The report welcomes the Joint Declaration against the death penalty, signed by the Presidents
of the European Parliament, of the Council and of the Commission, on behalf of the EU, and
by the President of the Parliamentary Assembly, the Chairman of the Committee of Ministers
and the Secretary General of the Council of Europe; calls on the Presidency to encourage
Italy, Latvia, Poland and Spain, which have signed but not yet ratified Protocol No 13 to the
ECHR concerning the abolition of the death penalty in all circumstances, and welcomes the
abolition of the death penalty in Rwanda and Uzbekistan; calls on the Council and the
Commission to enhance the cooperation with the Council of Europe for the purposes of
creating a Europe-wide zone free from torture and other forms of ill-treatment, as a clear
signal that European countries are firmly committed to eradicating these practices also within
their borders; welcomes the adoption of the European Council conclusions on the rights of the
child; calls on those Member States (Czech Republic, Finland, Germany, Hungary, Ireland,
Luxembourg, Malta or the United Kingdom) to ratify without delay the optional protocols to
the Convention on the Rights of the Child; Expresses its concern at the human rights
situations in Nicaragua (the attacks against and harassment of a number of human rights
organisations), in Iran (suppression of the independent human rights defenders and members
of civil society; the arbitrary arrest, torture and imprisonment of human rights defenders for
their work), in China (postponement of the ninth China-EU summit on the grounds of the
Dalai Lama's visit to Europe) and in Belarus; calls on their governments to stop the violation

human rights defenders and the difficulties faced by NGOs with regard to their registration
and in carrying out their activities); regrets that the European Union has not succeeded in
bringing about any change of policy in Russia; urges the Council and the Commission to set
up human rights subcommittees with all neighbourhood countries; welcomes the Council's
proposals for launching human rights dialogues with a number of Latin American countries
and stresses the desirability of including the countries of Central America; Stresses the
importance of economic, social and cultural rights, and calls on the EU to support the
achievements of the Millennium Development Goals;
2. Report on the development of the UN Human Rights Council, including the role of the
EU (2008/2201 (INI)); rapporteur Laima Liucija Andrikienė (PPE-DE); adopted on
02/12/2008 in AFET, on 14/01/2009 in plenary
Welcomes the work carried out by the UN Human Rights Council in its first two years of
existence but regrets that it has not yet achieved more in improving the UN's human rights
record; calls on the EU to play a more prominent role in promoting a clear vision, political
agenda and long-term strategy for the UN body, regretting, despite some achievements such
as the EU's call for special sessions on Darfur, Myanmar and the East of the Democratic
Republic of Congo, the rather defensive attitude adopted by the EU in the UNHRC, in
particular its reluctance to put forward resolutions on country situations; urges EU countries
to make better use of their potential influence as the leader of a group of democratic countries
with solid human rights records.
Comments on impact of AFET work in the 6th parliamentary term
On the basis of the work of AFET and, in particular, its Subcommittee on Human Rights,
Parliament has been following developments in and at the level of the UNHRC since its
setting-up, through resolutions on EP priorities for specific sessions and regular delegations
to observe the UNHRC's work. After almost 3 years of functioning of the UNHRC during
which the institutional reform was fine-tuned, the report was a means of assessing the
achievements of the Council as well as ways in which the EU could improve its influence in
the HRC and, by doing so, give a new impetus to the Council. Given the review procedure of
the Council five years after its creation, i.e. in 2011, this report was a useful benchmarking
exercise, to be repeated possibly just before the review.
3. Report on the evaluation of EU sanctions as part of the EU's actions and policies in
the area of human rights (2008/2032 (INI)); rapporteur Hélène Flautre (VERTS/ALE);
adopted on 15/07/2008 in AFET, on 04/09/2008 in plenary
Calls on the European Union to improve the way it uses sanctions as a foreign policy
instrument, highlighting the need for greater coherence in the use of sanctions, including
better analysis and impact assessments, to make EU sanctions more effective such as in-depth

analysis of each specific situation prior to the adoption of sanctions and clear and specific
benchmarks as conditions for the lifting of sanctions; recommends the creation by the
Commission of a 'network of independent experts' to advise on sanctions; urges to include in
the reasons for imposing sanctions the voluntary and irreversible degradation of the
environment; accent on necessity to make sanctions part of a coherent human rights strategy;
targeted sanctions preferred so as to spare populations and urge that they be systematically
accompanied by positive measures to support civil society, human rights defenders; calls to
review the existing procedure for blacklisting and delisting, in order to respect blacklisted
individuals' and entities' procedural and substantive human rights.
Comments on impact of AFET work in the 6th parliamentary term
Alongside the reports on Human Rights Clauses and Dialogues, this report constitutes a
fundamental element of the 'trilogy' assessing the main human rights instruments of EU
foreign policy and a basis for future scrutiny by the EP of developments in this respect.
Following a short-term follow-up to the report by the Subcommittee on Human Rights, the
Commission forwarded to members the relevant information regarding recent sanctions
imposed or prolonged, and assured DROI it would continue to do so in the future. While
stating that the usefulness of a network of independent experts would require further
examination, the Commission announced, as regards sanctions legislation (blacklisting and
de-listing), that it would make proposals or take action as necessary to bring the listing
procedures in line with relevant case-law.
4. Report on the Annual Report on Human Rights in the World 2007 and the European
Union's policy on the matter (2007/2274 (INI)); rapporteur: Marco Cappato (ALDE, IT);
adopted on 14/04/2008 in AFET, on 08/05/2007 in plenary
The report deplores the fact that that the EU is still far from conducting a coherent and hardhitting policy to uphold and promote human rights around the world; calls on the member
states to strengthen the EU's common foreign and security policy (CFSP), which is often
hampered by the predominance of Member States' national interests, with the aim of ensuring
that the promotion of human rights is regarded as a priority; calls on the Council and the
Commission to make greater efforts to improve the ability of the EU to respond rapidly to
breaches of human rights by third countries, not least by mainstreaming human rights policy
into all external EU policies vis-à-vis such countries and systematically addressing human
rights issues within the framework of the political dialogue at all levels; reaffirms that human
rights are universal and indivisible, effective respect for which is an essential means of
guaranteeing the enforcement of international law and order, and the promotion of peace,
freedom, justice and democracy; calls on the EU to support judicial institutions at all levels,
and in particular to provide support for international courts; proposes that a European
Conference on Non-Violence be convened in 2009 and that 2010 be designated 'European
Year of Non-Violence'; calls on the Member States to endeavour, under the auspices of the
United Nations, to ensure that the 'Decade of Non-Violence 2010-2020' is proclaimed; calls
on the Council and the Commission to identify the 'countries of particular concern' where it is
particularly difficult to promote human rights and, to that end, to develop criteria by which to
measure countries by reference to their human rights score.
Notes that the UNHRC has the potential to develop into a valuable framework for the

European Union's multilateral human rights efforts; trusts that the implementation of the
Universal Periodic Review mechanism will achieve the first concrete results and
improvements; calls on the Council and the Commission closely to monitor this process;
welcomes Resolution (62/149) adopted by the United Nations General Assembly (18
December 2007), calling for a global moratorium on the use of the death penalty, and also
welcomes the abolition of the death penalty in Albania, Kyrgyzstan, Rwanda, in the State of
New Jersey (USA) and Uzbekistan in 2007 and the beginning of 2008; expresses disquiet at
the possibility that the death penalty might again start to be enforced in Guatemala, and are
concerned about China as the latter still carries out the greatest number of executions
worldwide; condemns the practising of the death penalty in Belarus, and also condemns the
Iranian regime's increasing use of capital punishment.
The report calls on the Council and the Commission to enhance the cooperation with the
Council of Europe for the purposes of creating a Europe-wide zone free from torture and other
forms of ill-treatment (as a clear signal that European countries are firmly committed to
eradicating these practices also within their borders).
Requests the regular presence of the Presidency or the Council Secretariat in the relevant
United Nations Committees as well as further cooperation with the Council of Europe and its
Committee for the Prevention of Torture in order to achieve useful material input into
decision-making concerning demarches towards certain countries; calls on the Council and
the Commission to engage in a more transparent implementation of the European Union
Guidelines on Human Rights Defenders; points out the lack of EU demarches on behalf of
human rights defenders in certain countries (in China, Tunisia, Ethiopia, Iran and Russia),
appears to reflect a lack of consensus among EU Member States, with individual Member
States prioritising different foreign policy interests and thus making collective action
impossible; regrets the lack of results from the European Union-Russia consultations on
human rights and regrets that the European Union has not succeeded in bringing about policy
change in Russia, particularly in Chechnya and other Caucasian Republics; protests against
the deplorable situation regarding human rights in the Maghreb countries (in Syria and in
Uzbekistan), in Burma, Sudan and Pakistan.
Calls on the Council, the Commission and Member States to use the human rights clause to
make combating all forms of female genital mutilation a priority issue in relations with nonMember States (particularly those States that have preferential relations with the EU within
the framework of the Cotonou Agreement; urges the Commission, within its EU foreign trade,
investment and development policies, to ensure that the economic activities of EU private
companies in third countries abide by international human rights standards (as regards the
exploitation of natural resources and the international obligation to obtain the prior and
informed consent of local communities and indigenous people affected).
5. Report on the functioning of the Human Rights Dialogues and consultations on
Human Rights with Third countries (INI/2007/2001); rapporteur Elena Valenciano
Martínez-Orozco (PSE); adopted on 30/07/2007 in AFET, on 06/09/2007 in plenary

Stresses that the universality, individuality and indivisibility of human rights, meaning not
only civil and political rights but also social, environmental, economic and cultural rights,
must be upheld and promoted; highlights that human rights issues should be placed at the
highest political level in order to give more political weight to human rights concerns.
Expresses that the promotion and defence of human rights in third countries not be
conditioned by geopolitical or geo-strategic alliances; stresses that, within the framework
of political, economic and trade-related dialogues, respect for human rights should be
fundamental to strategic and privileged relations with the EU.
Notes that there is a wide variety of dialogues and consultations, each based on different
structures, formats, frequencies, and methodologies, but that neither the Council nor the
Commission has devised a method for organising and systematising these dialogues and
consultations, making the results impossible to view from an overall perspective. In order to
increase coherence, stresses to find ways of improving coordination among the different EU
institutions by establishing an interinstitutional trialogue on the political dialogue and the
human rights dialogues and consultations; recommends increasing coherence with other states
and international organisations.
Makes a series of recommendations to the Council and to the Commission: to include in
each Country Strategy Papers and other Strategy documents a specific strategy on human
rights and the situation pertaining to democracy and to use it as a framework for political
dialogue; to ensure that, within the staff serving at any given time in each EU delegation in a
third country, an EU official is in charge of the human rights dialogue and consultations; to
ensure coherence between Election Observation Missions (especially as regards the postelectoral strategy) and the process of human rights dialogues and consultations. Calls on the
Commission to put in place, together with the European Parliament and third countries
concerned, a post-electoral protocol mechanism to monitor and support the democratisation
process, which includes the involvement of civil society at all stages, in the implementation of
post-electoral recommendations; to apply and use the results of human rights dialogues and
consultations in drawing up yearly strategies providing a basis for implementation of projects
under the European Instrument for Democracy and Human Rights (EIDHR) and
systematically to link those two tools.
Suggests measures with the aim of increasing the transparency of, and publicity given to,
human rights dialogues and consultations. Calls on the Council to ensure that, before the EU
sets the specific goals to be attained by entering into a dialogue or consultation with the
country in question, consultations are first held with all interested parties, especially with
Parliament and NGOs. In addition, calls on the Council to set clear criteria for the initiation,
suspension or termination of a dialogue or consultation and to establish effective follow-up
mechanisms to deal with the points raised and in the final recommendations.
Suggests a series of measures for enhancing the role of the European Parliament and
moved on to discuss the functioning of the various forms of human rights dialogues and
consultations with third countries, including the structured dialogues with China and Iran, the
consultation with Russia, dialogues based on the Cotonou Agreement, dialogues with Central
Asia dialogues based on a partnership and cooperation agreement under the Neighbourhood
Policy, with Latin America, dialogues based on trade and cooperation agreements, and, ad hoc
dialogues.

Comments on impact of AFET work in the 6th parliamentary term
Alongside the reports on Human Rights Clauses and Sanctions, this report constitutes a
fundamental element of the 'trilogy' assessing the main human rights instruments of EU
foreign policy and a basis for future scrutiny by the EP of developments in this respect.
Following several interinstitutional discussions on the follow-up to the report, the
Commission and Council ensured that interested Members received regular briefings and
debriefings on the most important human rights dialogues and consultations in an informal
confidential manner, enabling Parliament to have increased influence and oversight over the
dialogues. In 2007-2008 a total of five such meetings took place, in relation to China,
Uzbekistan, the African Union, Israel and Egypt.
6. Report on the Annual Report on Human Rights in the World 2006 and the EU's
policy on the matter (2007/2020 (INI)); rapporteur: Simon Coveney (PPE-DE, IE); adopted
on 10/04/2007 in AFET, on 26/04/2007 in plenary
The report focuses on assessment of the five sets of EU Human Rights Guidelines on the
death penalty, children in armed conflict, human rights dialogues, torture and human rights
defenders; Focuses on the EU's role in the new UN body dealing with human rights: the UN
Human Rights Council (UNHRC); notes the high degree of politicisation of UNHRC special
sessions, and cautions that the UNHRC 'must not become a political forum for conflict
between different geographical and ideological blocks globally'. Highlights the weakness of
the UNHRC resolution on Darfur and urges the UNHRC to adopt appropriate and strong
measures to respond to the humanitarian catastrophe in Darfur; urges the EU to back 'an
international peacekeeping force' and 'the enforcement of the no-fly zone over Darfur'.
Emphasises the need to improve and strengthen EU-China human rights dialogue, and urges
the Council and Commission to raise the Tibet question in talks with the Beijing government.
Calls on the Council to express concern about the situation in all its contacts with the Iranian
government and also calls on the Commission to use the European Initiative for Democracy
and Human Rights (EIDHR) to promote contacts and cooperation with Iranian civil society.
Reserves strong criticism for the Russian government, 'regretting' that the EU has had 'only
limited success in bringing about policy change as a result of raising difficult issues', such as
the situation in Chechnya, the treatment of human rights defenders (remains 'appalled' at the
murder of Anna Politkowskaja' and is concerned about allegations of Russian involvement in
the poisoning of Alexander Litvinenko and of the mistreatment of Mikhail Khodorkovsky
while in detention), and freedom of expression. The Parliament urges the Commission and
Council to raise such cases with the Russian authorities at the highest level and in the new
PCA with Russia. Welcomes Chad as the most recent signatory to the Rome statute of the
International Criminal Court; urges the Czech Republic, as the only remaining EU Member
State not have ratified the Statute, to do so without delay, and discourages the United States
from actively preventing other countries from ratifying this statute. Recognises attempts to set
up a human rights dialogue with Uzbekistan (considers that such a dialogue should not
automatically lead to the lifting of sanctions, if no progress is made in the area of human
rights and democracy).

Guantánamo detainees 'in accordance with international law'; shows its concern about the
'limited progress' on human rights issues in Turkey and encourages the Ankara government to
change Article 301 of the Penal Code. Criticises the EU institutions' activity in the area of

7. Extension of the European Initiative for Democracy and Human Rights and the
European Instrument for Democracy and Human Rights Worldwide (CNS/2004/0807);

plenary, and (COD/2006/0116); rapporteur Edward McMillan-Scott (EPP) and Hélène Flautre
(VERTS/ALE); adopted on 10/10/2006 in AFET, on 12/12/2006 in plenary
Awaiting the agreement on the reform of all external financial instruments, the report adopted
in 2004 was mainly an extension for a further two years (until 31.12.2006) of the period of
validity of Council Regulation 976/1999/EC. The same was done for the parallel regulation
(975/99/EC) on respect for human rights within the framework of development cooperation,
as the EIDHR was split into two regulations for legal reasons.
The new EIDHR, (Regulation EC 1889/2006) is part of the new structure of the financial
instruments. Initially, it was proposed to be a thematic programme under the Development
Cooperation Instrument, but the European Parliament, for reasons of visibility and
independence, pushed for a separate instrument. Overall, this Instrument will provide
assistance in the area of cooperation aimed at:

enhancing respect for and observance of human rights and fundamental freedoms,
promoting and consolidating democracy and democratic reform in third countries,
providing support and solidarity to human rights defenders and victims of
repression and abuse, and strengthening civil society active in the field of human
rights and democracy promotion;

supporting and strengthening the international and regional framework in this
area;

building confidence in and enhancing the reliability of electoral processes, in
particular through election observation missions, and through support for local
civil society organisations involved in these processes.
Through a call for proposals, published by Headquarters in Brussels and at local level by the
EC delegations, almost 400 projects have so far been financed under the new instrument,
mainly in cooperation with civil society. Some targeted projects, together with the Council of
Europe, or contribution to the UN Office of the High Commissioner for Human Rights, are
also financed under this instrument, as well as all the EU EOMs.

Comments on impact of AFET work in the 6th parliamentary term
As for all the other external financial instruments, the supervisory role of the EP regarding
the legal as well as the democratic scrutiny of this regulation was increased. A working
group, consisting of 1 member from each political group (2 for PPE and PSE) was created,
including the two rapporteurs. This working group has met regularly with the Commission
services, mainly to discuss the Strategy Paper and further on the Annual Action Plans, as well
as to have a regular update on the implementation of the instrument. The adoption of the
policy documents has been dealt with through exchanges of letters, where the comments and
proposals of the European Parliament have been expressed. Exchanges of views on the
EIDHR have also been organised in DROI. The EIDHR is of course also part of the
budgetary procedure, included in the opinions elaborated by the AFET budgetary draftsman.
8. Report on the Annual Report on Human Rights in the World 2005 and the EU's
policy on the matter (2005/2203(INI)); rapporteur: Richard Howitt (PSE, UK); adopted on
06/05/2006 in AFET, on 18/05/2006 in plenary
The report singles out areas where the Council's activity was deserving of praise (the UK
Presidency's efforts to combat the death penalty and promote freedom of expression, and the
Austrian Presidency's promise to 'continue the practice of demarches in respect of all of the
EU's international partners regarding the ratification of international conventions banning the
use of torture'); Congratulates the Council and the Commission for the substantial diplomatic
success in achieving the referral by the UN Security Council of the case of Darfur in Sudan to
the ICC; at the same time expresses concern at the deteriorating security situation in Darfur,
and urges the international community to act immediately to stop the violence, while
providing substantial support to the African Union as well as a sufficient level of
humanitarian aid to the population affected.
Welcomes the inclusion of human rights issues in the European Neighbourhood Policy (ENP),
and commends the 'increasing effectiveness of EU electoral observation activities.' Praises the
Council for imposing sanctions on Uzbekistan, and reiterated their condemnation of the
violent repression in Ethiopia and human rights abuses in Tunisia; 'continuing reports of a
long list of human rights abuses' in China, the 'extrajudicial killings, disappearances and
torture in custody in Chechnya,' and 'Iran's poor human rights record'; welcomes for EU
support for the new government in Iraq; asks Council and Commission to 'call upon the US
government immediately to close the Guantanamo detention centre' and give the prisoners a
fair trial; calls for a 'clear system of sanctions' to be applied to countries that violate the
human rights clause in agreements with the Union;
Welcomes the first year of activities of the Subcommittee on Human Rights within the
Foreign Affairs Committee, which had created a focal point for activities on human rights
which was absent during the last parliamentary term. Calls on the Subcommittee to consider
setting up small informal working groups to follow each set of Guidelines, so as to be better
able to follow the Council's work in this regard and to submit proposals; Calls the
Commission to designate at least one permanent post in each third-country delegation as
having responsibility for monitoring the human rights situation in the country concerned,

promoting international human rights standards and being in charge of relations with civil
society, such as relations with human rights defenders.
9. Report on the Human Rights and Democracy Clause in European Union agreements
(INI/2005/2057); rapporteur Vittorio Agnoletto (GUE/NGL); adopted on 23/11/2005 in
AFET, on 14/02/2006 in plenary
In this report the EP welcomed the European Community's general practice of incorporating
human rights and democracy clauses – the so-called 'essential elements' and 'non-execution'
clauses – into its international agreements since 1992. The clause has now been introduced
into more than 50 agreements and applies to more than 120 countries. However, many
sectoral agreements, such as those on textiles, agriculture and fisheries, as well as agreements
with developed countries, still lack the clause. Parliament stated that it was no longer prepared
to give its assent to new international agreements that do not contain a human rights and
democracy clause.
One of the factors that has compromised the application of the clause, was, according to the
resolution, the generic nature of its wording: this does not spell out detailed procedures for
'positive' and 'negative' interventions under EU/third country cooperation. Parliament
advocated the drafting of a new 'model clause' to correct the current wording, and a clear
mechanism based on Articles 9 and 96 of the Cotonou Agreement.
Parliament requested an increased role both in defining the negotiation mandate, the process
leading up to the decision of the suspension of an agreement and in the monitoring, by being
associated with the Association Councils and with the subcommittees on human rights. It also
argued for an increased role for the civil society.
Comments on impact of AFET work in the 6th parliamentary term
The Subcommittee on Human Rights has tried to provide a continuous follow-up to the report.
Several of the requests of the report have been taken up in the Annual Report on Human
Rights and the inclusion of human rights clauses in sectoral agreements has been repeated in
responses to legislative programmes. The role of the clauses has been emphasized in all
agreements, and sometimes, the human rights aspects have played a crucial role for the
conclusion or postponement of an agreement, such as in the case for Turkmenistan. The
Council is currently looking into the possibility of using Articles 9 and 96 as a model for all
clauses.
10. Report on the Annual Report on Human Rights in the World 2004 and the EU's

The report focuses on issues in different regions and countries (the EU's Eastern
Neighbourhood; Russia as a neighbour; the EU's Southern and South-Eastern Neighbourhood;
Asia; Africa and the Americas) highlighting human rights abuses, and progress; Addresses a
number of wider themes, including human rights and the fight against terrorism, children's
rights, the impact of conflict on women and children, abolishing the death penalty, trafficking
in humans and human organs, the sex industry and child labour, the role of international
business in human rights and impunity and the role of the international criminal court; calls

for the European Union to provide balanced leadership between the responsibility for human
rights and the fight against international terrorism; Urges strongly the Member States to use
their influence to press countries to abolish the death penalty (in China, the USA, Saudi
Arabia and others).
Welcomes the efforts to address the plight of victims of past human rights abuses in Morocco,
particularly the establishment of the Equity and Reconciliation Committee; recognises the
right of Israel to take measures to provide security for Israelis, and reminds the latter that any
counter-terrorism measures taken cannot ignore human rights considerations; expresses
concern at the existence and scale of a security fence and separation barrier in large parts of
the West Bank and its implications for the human rights of local populations; recognises the
difficulties faced by the new authorities in Iraq in their efforts to establish law and order with
the help of the military forces stationed there and expresses its concern regarding the present
situation; Calls on the Council and Commission to prioritise children's rights within the EU's
development policy; as well as calling on the Commission to provide a paper on children's
rights and present it to Parliament.
The report mentions the continuing abuse of women and children in armed conflict
particularly on the continent of Africa; Criticises the reversal of EU policy by the Council in
relation to the embargo on arms sales to China and calls for the arms embargo to remain intact
until greater progress is made on human rights issues. Condemns the US Government for the
treatment to which prisoners have been subjected in Guantanamo and calls on the US
government to ensure all its prisoners (including those held in Guantanamo detention camp,
are granted minimum human rights in accordance with international human rights law and fair
trial procedures); calls on the USA to submit a report to the UN Human Rights Committee on
its compliance with the International Covenant on Civil and Political Rights (ICCPR).
