ALCOL
A) La legge vieta la vendita e la somministrazione di bevande alcoliche ai minori di 18 anni. Sanzioni: - nel caso di vendita di
bevande alcoliche a minori di 18 anni si applica la sanzione pecuniaria fino a un massimo di € 1000; - nel caso di somministrazione di bevande alcoliche a minori, tra i 16 i 18 anni, sanzione fino a € 1000 - la somministrazione di alcol a minori di 16 anni,
comporta anche l’arresto fino ad un anno (art. 689 C.P.);
B) Nei negozi è necessario esporre un cartello che indica il divieto di vendita di alcol ai minori. Se il cartello non c’è si rischia una
sanzione fino a € 300 (art. 42 bis R.P.U.)
C) E’ vietata la vendita di alcolici dopo le 24,00 e fino alle 6.00 (per gli esercizi di vicinato e le attività artigianali), salvo i casi autorizzati. Chi non rispetta tale divieto rischia una sanzione fino a € 6667; (per i pubblici esercizi e circoli gli orari del divieto sono
dalle 03.00 alle 06.00, per le attività di vendita su area pubblica dalle 24.00 alle 07.00).
D) E’ vietata la vendita di alcolici tra le 24.00 e le 06.00 anche attraverso i distributori automatici in locali appositamente dedicati. In questo caso la sanzione corrisponde ad € 6.667 – se collocati sull’area pubblica il divieto è esteso dalle 24.00 alle 07.00
e la sanzione prevista corrisponde ad € 10.000.
E) Il Questore può sospendere la licenza di un esercizio nel quale siano avvenuti tumulti o gravi disordini o che sia un ritrovo
abituale di persone socialmente pericolose. Sanzione: chiusura temporanea dell’esercizio.
F) Il Regolamento Comunale vieta la vendita con consumo immediato di alimenti (anche alcol) negli esercizi di vicinato, mediante somministrazione. (art. 36: Negli esercizi di vicinato abilitati alla vendita di prodotti alimentari è consentito il consumo
immediato degli stessi a condizione che non si effettui il servizio di somministrazione e che non vi siano attrezzature ad esso
direttamente finalizzate).
Pertanto, è vietato:
a) fornire contenitori, piatti, bicchieri e posate non monouso
b) mettere a disposizione del pubblico un’area attrezzata con elementi di arredo quali tavoli, banchi, sedie, sgabelli e panche. Il
divieto non sussiste per vassoi e attrezzature per la raccolta dei contenitori di alimenti e bevande dopo l’uso. La violazione a tali
disposizioni configura l’ipotesi di attività di somministrazione non autorizzata. Sanzione: € 1.032.
ALCOHOL
A) The law prohibits the sale and supply of alcohol to persons under 18 years of age. Penalties: if alcohol is sold to persons under
18 years of age, a fine is applied up to a maximum of €. 1,000; if alcohol is given to minors between 16 and 18 years of age, a
fine is applied up to €. 1,000; - if alcohol is given to minors under 16 years of age, this also entails imprisonment of up to one year
(Section 689 Penal Code);
B) Stores must display a sign indicating that the sale of alcohol to minors is prohibited. If the sign is not displayed, the risk is a
fine of up to €. 300 (Section 42a R.P.U.).
C) The sale of alcohol after 12:00am and until 6:00am is prohibited (for neighbourhood and skilled trade businesses), unless
otherwise authorized. Those who do not respect this ban face a fine of up to €. 6,667; (for businesses and clubs, the ban is from
3:00am until 6:00am and, for sales activities on public areas, from 12:00am until 7:00am).
D) The sale of alcohol between 12:00am and 6:00am is prohibited also through vending machines in specifically indicated
places. In this case, the fine corresponds to €. 6,667 - if on public ground, the ban is extended from 12:00am until 7:00am and
the fine corresponds to €. 10,000;
E) The Police may suspend the license of a business where riots or serious disorderly conduct has occurred or if it is a business
regularly visited by socially dangerous people. Fine: the business will be temporarily closed down.
F) Municipal Regulations prohibit the sale of food (including alcohol) in neighbourhood businesses that can be immediately
consumed, through supply of the same. (Section 36: In neighbourhood businesses authorized to sell food, immediate consumption of the same is allowed only if the food is not served and there is no equipment directly related).
Therefore, the following is prohibited:
a) providing containers, plates, cups, and cutlery that is not disposable;
b) providing the public with an area equipped with furniture, such as tables, benches, chairs, stools, and benches. The ban does
not exist for trays and equipment for collecting containers of food and drinks after use. The violation of these provisions hypothesize an unauthorized activity that supplies food and beverages. Fine: €. 1,032.
PULIZIA DELL’AREA
H) Il Regolamento Comunale prescrive che i titolari e gestori di esercizi commerciali o pubblici esercizi o attività artigianali,
devono provvedere alla rimozione giornaliera di immondizie, rifiuti o materiali in genere derivanti dalla loro attività, abbandonati
nelle immediate vicinanze dell’attività stesso, in modo che all’orario di chiusura dell’esercizio l’area in dotazione o comunque
antistante risulti perfettamente pulita. I titolari di esercizi commerciali o pubblici esercizi o attività artigianali sono tenuti a
provvedere alla rimozione giornaliera di bottiglie, lattine ed altri contenitori di bevande alcoliche anche non derivanti dalla loro
attività, in modo che all’orario di chiusura dell’esercizio l’area in dotazione o comunque antistante risulti perfettamente pulita.
Sanzione fino ad un massimo di € 500.

Art. 37 - Attività miste
1) Qualora nei locali in cui si esercita un’attività di produzione di beni o di servizi si svolga anche un’attività di commercio, occorre che la superficie destinata alla vendita sia delimitata con attrezzature od arredi atti ad individuarne permanentemente la
superficie.
2) I locali in cui si svolge la vendita devono rispondere ai requisiti previsti dalle norme in materia urbanistica ed edilizia, fatte
salve le deroghe previste dalla medesima normativa sulle destinazioni d’uso degli immobili .
3) Chi viola le disposizioni di cui al comma 1 è soggetto alla somma da € 77,00 a € 462,00 ed è tenuto alla regolarizzazione
dell’attività.
CLEANING THE AREA
H) Municipal Regulations require that the owners and operators of commercial or public businesses or skilled trade activities
must provide for the daily removal of garbage, waste, or materials that generally arise from their activities and are abandoned

Additional Information
Section 37 - Mixed Activities
1) If in premises where the production of goods or services takes place, a business activity is also practiced, it is necessary that
the surface area used is closed off with furnishings or other objects that permanently identify the surface area.
2) The premises where the sale takes place must meet the requirements provided for by the relevant norm regarding town
planning and construction, subject to the exceptions provided for by the same legislation regarding intended use of the properties.
3) Those who violate the provisions referred to in paragraph 1 shall be subjected to the administrative penalty of the payment
of a sum of €. 77.00 to €. 462.00 and are required to legalize the activity.
Commercio su area privata – esercizi di vicinato
D.Lgs 114/98 (modificato da art. 65 D.Lgs 59/2010)
Art. 4 C.1 - Definizioni e ambito di applicazione
Si considerano “esercizi di vicinato” quelli: - con superficie di vendita NON superiore a 150 mq , nei comuni con meno di 10.000
abitanti - con superficie di vendita Non superiore a 250 mq, nei comuni con più di 10.000 abitanti. Per l’apertura occorre presentare la SCIA al Comune. Sanzioni: - L’apertura, il trasferimento, l’ampliamento della sup. di vendita, la vendita di prodotti non del
settore dichiarato, comportano la sanzione amm.va pecuniaria pari a € 5.164. La presentazione di SCIA irregolare/incompleta
è sanzionata con € 5.164. Nel caso si tratti di esercizi che vendano ALIMENTARI, sono soggetti a NOTIFICA SANITARIA alla ASL

ART. 11 - orari di apertura
1. Gli orari dei negozi e degli esercizi di somministrazione sono rimessi alla libera determinazione degli esercenti,con possibilità
di apertura h24 per la somministrazione e il commercio.
2. Va reso noto al pubblico l’orario di effettiva apertura e chiusura dell’esercizio di vendita mediante cartelli o altri mezzi idonei
di informazione. Sanzione, nel caso non venga fatto: € 1.032,00.
ART. 14 - prezzi
I prodotti esposti per la vendita al dettaglio devono riportare in modo chiaro e ben leggibile il prezzo di vendita al pubblico,
mediante l’uso di un cartello o altra modalità. Per alcuni generi il prezzo è indicato per unità di misura (es: Kg di pane, di carne,
di prodotti di gastronomia, di ortofrutta, …) Il cambio della merce già acquistata, è facoltà del commerciante, mentre permane
l’obbligo di sostituzione del bene nel caso che la merce sia difettosa. Sanzione: omessa indicazione del prezzo o non chiara e
ben leggibile € 1.032,00.
IMPORTANTE - Per i Clienti
1bis) E’ fatto divieto su aree pubbliche o soggette a uso pubblico, di consumare o detenere a scopo di consumo ogni genere
di bevanda alcolica in contenitori di ogni genere. Il divieto non si applica per le consumazioni effettuate all’interno di pubblici
esercizi e nelle aree concesse per il plateatico ai pubblici esercizi nonché nelle aree immediatamente adiacenti, durante l’orario
di apertura. La violazione comporta una sanzione amministrativa fino a € 300,00 e la cessazione dell’attività da effettuarsi
mediante lo smaltimento secondo le indicazioni fornite dall’organo accertatore.
Business on private area - neighbourhood Business
LEGISLATIVE DECREE 114/98 (amended by section 65 - 59/2010)
Section 4 C.1 -definitions and scope of application
The following are considered “neighbourhood businesses”: - with a surface area used for sales that does NOT exceed 150 square meters in municipalities with less than 10,000 inhabitants; - with a surface area used for sales that does NOT exceed 250
square meters in municipalities with more than 10,000 inhabitants. To open a neighbourhood business, you must submit a SCIA
(start of business certificate) to City Hall. Penalties: - The opening, transfer, expansion of sales surface, the sale of products not
related to the specified sector, involve a pecuniary administrative fine equal to € 5164 - An irregular/incomplete SCIA will be
sanctioned with € 5,164 In the case of businesses that sell FOOD, these are subjected to a HEALTH NOTIFICATION to the relevant
ASL. (Local Health Unit).
SECTION 11 - opening hours
1. Shop and business hours are left to the merchants/store owners to decide, with the possibility of opening 24 hours for supplying and selling.
2. The actual opening and closing times must be made known to the public by posting signs or other means of information. If not
carried out, the fine will be: €. 1,032.00.
SECTION 14 - prices: The selling price on the products displayed for sale to the general public must be clear and legible
using signs or other similar methods. For some items, the price is indicated as a unit of measure (ex. kilo of bread, meat, deli
products, fruits and vegetables...). The possibility to exchange goods already purchased is the decision of the owner. Instead,
the owner is obligated to replace goods if they are damaged or faulty. Fine: failure to indicate the price or if not clear and legible:
€. 1,032.00.
IMPORTANT - For Clients
1a) It is prohibited, on public areas or those subjected to public use, to consume or possess with the purpose to consume, any
kind of alcoholic beverage in any type of container. This ban does not apply to drinks made inside the premises of the business
and in the areas used for public businesses, nor the nearby areas, during opening hours. The violation is a fine of up to €. 300.00
and stopping the activity through removal according to the indications given by the investigating organ.
