ALLGEMEINE VERKAUFSBEDINGUNGEN
CONDIZIONI GENERALI DI VENDITA
1 - ORDINAZIONI - Gli ordinativi del materiale, si intendono sempre
salvo accettazione e conferma della casa. Eventuali varianti, esazioni,
trattative, abbuoni, ecc... fatti da agenti o intermediari, non sono valide
senza la Ns. conferma scritta.
2 - PREZZI - I prezzi indicati in listino si intendono sempre per pagamento in contanti, al netto di imposte, imballi e franco fabbrica. Tali
prezzi sono comunque impegnativi per l’azienda soltanto per materiale
pronto a magazzino e per consegna immediata. Per consegne differite,
i prezzi saranno quelli in vigore al momento delle singole consegne.
3 - PERCENTUALI DI SCELTA E COLORI - Il materiale viene fornito
nelle percentuali di scelta uscenti dalla lavorazione, conformemente agli usi e consuetudini vigenti in materia e alla disponibilità di
magazzino al momento della spedizione. I colori dei campioni che
eventualmente accompagnassero l’offerta, sono sempre da intendersi
puramente indicativi e non vincolano la casa.
4 - TRASPORTO E SPEDIZIONE - La merce viaggia sempre e comunque a rischio e pericolo del compratore; ciò anche nel caso in cui
venga pattuita la consegna del materiale franco destino.
5 - TERMINE DI CONSEGNA - I termini di consegna sono approssimativi. Eventuali ritardi non danno diritto al compratore di risolvere
il contratto o di rifiutare di ricevere la consegna ed in ogni caso di avanzare richieste per danni.
6 - PAGAMENTI - I pagamenti sono validi solo ed esclusivamente se
effettuati presso la nostra sede legale, a mani di persone espressamente autorizzate a riceverli. I termini di pagamento sono sempre inderogabili; eventuali ritardi nel pagamento saranno sanzionabili con l’addebito
di interessi al tasso ufficiale annuo di sconto e ciò senza necessità di
preventiva messa in mora. Riservato dominio: la merce resta di proprietà della Ns. società, fino al momento del completo pagamento ed
al prezzo convenuto. Per le forniture di materiale con importo inferiore
a Euro 500 sarà emessa R.B. a sessanta giorni data fattura, indipendentemente dalle normali condizioni riservate all’Acquirente. Per i
pagamenti previsti in più rate oltre i trenta giorni l’importo I.V.A. sarà
addebitato totalmente sulla prima rata.
7 - RECLAMI - Il gres porcellanato Nordstyle, è garantito conforme alle
norme UN EN 14411 attualmente in vigore, la garanzia è limitata solo ai
materiali di 1a scelta, con una tolleranza del 5% circa. Rimane quindi
completamente esclusa per i materiali di 2a scelta, 3a scelta, RF, stock
o partite occasionali e speciali che si intendono sempre vendute come
“viste e piaciute” e con esclusione di qualsivoglia garanzia anche per i
vizi occulti. Non si accettano reclami decorsi otto giorni dalla consegna del materiale, e comunque quando lo stesso è già stato posato.
In caso di fondato reclamo entro i termini suddetti, la venditrice potrà
provvedere, a suo insindacabile giudizio, al ritiro del materiale e alla
sostituzione dello stesso o, in alternativa alla risoluzione del contratto.
Viene comunque esclusa la possibilità per il compratore di avanzare
richieste di risarcimento danni in dipendenza di questi fatti. Non possono dare luogo a contestazioni, leggere variazioni di colore che sono
caratteristiche dei materiali altamente greificati. I materiali di 2a e 3a
(Stock) scelta, e le partite occasionali si intendono venduti come visti e
piaciuti. Non sono accettate contestazioni riguardanti leggere differenze di calibro tra i formati e i pezzi speciali (gradini, zoccoli, talloni,
battiscopa) ecc...
8 - COMPETENZA - Per qualunque controversia comunque relativa
alla fornitura, competente a giudicare con esclusione di qualunque
altro foro è il Foro di Modena.
Imballo: Gratuito in scatole di cartone.
Pallets:Euro 6.50 cadauno compreso di termoretraibile.
Resa: Franco ns. stabilimento di Sassuolo (MO).
IVA: A carico del committente.
N.B. NON SI ACCETTANO ASSOLUTAMENTE CONTESTAZIONI SUI

GENERAL TERMS OF SALE
1 - ORDERS - Orders for goods are always subject to acceptance and
confirmation by the Manufacturer. Any alteration, levy, deal or rebate,
or the like, granted by agents or intermediaries are not valid unless
confirmed by us in writing.
2 - PRICES - The prices indicated in the price list are always for
payment in cash, net of taxation and packaging and are ex works. The
Manufacturer is only liable to apply these prices for goods in stock and
for immediate delivery. The prices applied to deferred deliveries will be
those that are valid at the time of each individual delivery.
3 - PERCENTAGES OF GRADES AND COLOURS - The goods are
supplied in the same percentages of grades that exit production, according to current common practice and also according to the availability of stock at the time of shipment. The colours of the samples that
may accompany an offer are always approximate and are not binding
for the Manufacturer.
4 - TRANSPORT AND SHIPMENT - The goods are always transported
at the buyer’s risk, even when delivery of the goods is stipulated to be
carriage paid.
5 – DELIVERY DATE- When indicated, the delivery date is approximate.
Any delay does not entitle the buyer to cancel the contract or refuse
delivery, or give rise to claim for damages.
6 - PAYMENTS - Payments are only valid if they are collected in our
registered offices by people who have been expressly authorized by us
for the collection of payments. Terms of payment are always final; any
delay in payment will be subject to sanction by the charging of interest
at the official annual interest rate without any obligation as regards
prior confirmation of arrears. Ownership: the goods remain the property of the Manufacturer until payment of the agreed price has been
received in full. A draft at sixty days from the invoice date will be issued
for supplies of goods amounting to less than 500 Euro (two hundred
and fifty-nine), regardless of the Buyer’s standard terms. For payments
by instalment in excess of thirty days, the amount relating to the VAT
will be payable in full at the first instalment.
7 - CLAIMS - Nordstyle porcelain stoneware is guaranteed to comply
with current UN EN 14411 standards. This guarantee is limited to first
grade goods, with a tolerance of approximately 5%. It is not, therefore,
applicable for second, third or KR (kiln rendered) grade goods, stock or
odd and special batches, which are always sold “seen and approved”
and also exclude any guarantee relative to latent faults. Claims must
be filed within eight days of the delivery of the goods, and cannot be
made after the tiles have been laid under any circumstance. In case of
confirmed claim according to the terms mentioned above, the seller
may decide either to accept the return of the goods for replacement or
to cancel the contract. In any case, this does not give rise to any right
to claim for damages on the Buyer’s part. Slight variations in colour
– which are a feature of highly sintered materials – do not give rise to
claim. Second and third grade (stock) goods, and odd batches are sold
as seen and approved. Claims will not be accepted for slight variations
in the gauge of formats and special trims (steps, coving, risers, skirting)
etc.
8 - JURISDICTION – Judgement of any controversy regarding supply
will fall under the jurisdiction of the Court of Modena with the exclusion
of any other court.
Packaging: cardboard boxes, free of charge.
Pallets:Euro 6,50 /each, including heat-shrink wrap.
Delivery: Ex Works, Sassuolo (MO).
VAT: at the buyer’s expense.
NB: NO CLAIM WILL BE ACCEPTED FOR GOODS ALREADY LAID,
OR POLISHED, OR POLISHED ON SITE.

CONDITIONS GENERALES DE VENTE
1 – COMMANDES - Les commandes de matériaux, sont toujours entendues sauf acceptation et confirmation de la Maison. Les éventuels
variantes, recouvrements, négociations, remises, etc.., effectués par
des Agents ou des Intermédiaires, ne sont pas valables sans notre
confirmation écrite.
2 - PRIX – Les prix indiqués sur les tarifs sont toujours entendus pour
paiement contant, net de taxes, emballages et franco usine. De tels
prix toutefois n’engagent la Maison que pour les matériaux prêts en
entrepôt et la livraison immédiate. Pour les livraisons différées, les prix
seront ceux en vigueur au moment de chaque livraison.
3 – POURCENTAGE DE CHOIX ET COULEURS – Les matériaux
sont fournis suivant le pourcentage des choix sortant de la fabrication, conformément aux us et coutumes en la matière en vigueur et,
à la disponibilité en entrepôt au moment de la livraison. Les couleurs
des échantillons pouvant, éventuellement, accompagner l’offre, sont
toujours purement indicatives et n’engagent en aucun cas la Maison.
4 - TRANSPORT ET EXPEDITION - La marchandise voyage toujours,
aux risques et périls de l’acheteur, même lorsque la livraison des
matériaux est fixée franco destination.
5 – DELAIS DE LIVRAISON – Les délais de livraison sont approximatifs. Un éventuel retard ne donne en aucun cas à l’acheteur le droit de
résilier le contrat ou de refuser de recevoir la livraison et de prétendre
des dommages et intérêts.
6 – PAIEMENTS – Les paiements sont valables exclusivement si
effectués auprès de notre siège légal, par l’intermédiaire de personnes
autorisées expressément à les recevoir. Les délais de paiement sont
toujours inéluctables, tout retard éventuel dans le paiement pourra être
sanctionné par le débit des intérêts au taux d’escompte annuel officiel,
sans nécessité de mise en demeure préalable. Domaine réservé:
la marchandise reste propriété de notre société, jusqu’au paiement
complet au prix convenu. Pour les fournitures de matériel d’un montant
inférieur à 500 Euro (deux cents cinquante neuf euros) une LCR à 60
jours date facture sera émise, indépendamment des normales conditions réservées à l’acheteur. Pour les paiements prévus en plusieurs
versements à plus de trente jours le montant T.V.A. sera débité totalement sur le premier versement
7 - RECLAMATIONS – Le grès cérame Nordstyle, est garanti conforme aux normes UN EN 14411 actuellement en vigueur, la garantie
est limitée exclusivementement aux matériaux de 1° choix, avec une
tolérance de 5% environ. La garantie est donc complètement excluse
pour les 2èmes et 3èmes choix, “ tout four sortant ”, stock ou lots
occasionnels et spéciaux qui sont entendus toujours vendus comme
“vus et plus” et à exclusion de toute garantie même pour les vices
cachés. Passés huit jours de la livraison du matériau, aucune réclamation ne sera acceptée, et jamais quand celui-ci a déjà été posé. En
cas de réclamation fondée dans les délais ci-dessus, le vendeur pourra
pourvoir, à son jugement sans appel, au retrait du matériau et à son
remplacement ou, en alternative à la résiliation du contrat. Est excluse
toute possibilité à l’acheteur de formuler demande d’indemnisation
pour les dommages subis suite à ces faits. Les légères variations de
couleur qui sont caractéristiques des matériaux fortement gréseux
ne peuvent donner lieu à contestation. Les matériaux de deuxième et
troisième (Stock) choix, et les lots occasionnels sont entendus comme
vendus en tant que vus et plus. Toute contestation concernant des
légères différences de calibre entre les formats et les pièces spéciales
(marches, plinthes à talons, talons, plinthes à bord arrondi etc..) sera
refusée.
8 - COMPETENCE – Pour toute controverse relative à la fourniture,
seul le Tribunal de Modena est compétent à juger à exclusion de tout
autre.
Emballage: gratuit en boîtes de carton.
Palettes: Euro 6,50 chaque y compris le film thermorétractable.
Livraison: Franco notre établissement de Sassuolo (MO).
TVA: A charge du commettant.
N.B. AUCUNE CONTESTATION SUR LES MATERIAUX DEJA POSES
OU POLIS OU POLIS EN OEUVRE NE SERA ACCEPTEE.
ALLGEMEINE VERKAUFSBEDINGUNGEN
1 - AUFTRÄGE – Die Bestellungen des Materials, verstehen sich immer
unter Vorbehalt der Annahme und Bestätigung des Hauses. Eventuelle
Varianten, Einnahmen, Verhandlungen, Preisnachlässe etc. seitens
der Vertreter oder Vermittler sind ohne unsere schriftliche Bestätigung
ungültig.
2 - PREISE – Die in der Preisliste angegebenen Preise verstehen sich
immer bei Barzahlung, netto Abgaben, Verpackungen und ab Werk.
Diese Preise sind für die Firmen nur bei Material, welches an Lager ist
und umgehend geliefert werden kann, verbindlich. Für aufgeschobene
Lieferungen werden die Preise jene sein, die im Moment der einzelnen
Lieferung in Kraft stehen.
3 - PROZENTSATZ BEI WAHL UND FARBE – Das Material wird
zu einem aus der Produktion ausscheidenden Prozentsatz geliefert,
konform für den Gebrauch und der Gewohnheiten des geltenden Gegenstandes und des Lagerbestandes zum Zeitpunkt des Versands. Die
Farben der Muster, die eventuell dem Angebot beigelegt sind, dienen
nur als reiner Anhaltspunkt und sind für das Haus nicht bindend.
4 - TRANSPORT UND VERSAND – Die Ware reist immer und auf jeden Fall auf Risiko und Gefahr des Käufers hin; d.h. auch im Falle einer
Vereinbarung von Materiallieferung frei Haus.
5 - LIEFERZEIT – Die Lieferzeiten sind ungefähr. Eventuelle Verzögerungen geben dem Käufer nicht das Recht vom Vertrag zurückzutreten,
oder die Lieferung nicht anzunehmen, oder Schadenersatzansprüche
geltend zu machen.
6 - ZAHLUNGEN – Die Zahlungen haben ausschließlich Gültigkeit,
wenn diese in unserem Hauptsitz, vorgenommen werden. Die Beträge
dürfen nur an Personen, welche eine Genehmigung haben, übergeben
werden. Die Zahlungsbedingungen sind immer unaufschiebbar; eventuelle Zahlungsverzögerungen werden mit Verzugszins, in Höhe des
offiziellen Jahresdiskont-Zinssatzes, belastet, d.h. ohne Notwendigkeit
eines Kostenvoranschlags für Verzugszins. Reserviertes Eigentum:
die Ware bleibt bis zur endgültigen Begleichung des vereinbarten Preises, Eigentum unserer Gesellschaft. Bei Materiallieferungen unter Euro
500 (zweihundertneunundfünfzig Euro), wird eine Quittung , 60 Tage ab
Rechnungsdatum ausgestellt, unabhängig von den normalen Bedingungen, welche dem Käufer vorbehalten sind. Bei Zahlungen , die in
mehreren Raten vorgesehen sind, über 30 Tage, wird die Mehrwertsteuer vollumfänglich bei der ersten Rate in Rechnung gestellt.
7 - REKLAMATIONEN – Das Feinsteinzeug Nordstyle ist durch die
zum jetzigen Zeitpunkt in Kraft stehenden Normen UN EN 14411
garantiert. Die Garantie ist nur bei Materialien Wahl mit einer Toleranz
von zirka 5% begrenzt. Es bleibt somit vollständig Material 2. Wahl, 3.
Wahl, OW (Ofenwaren), Stock oder Gelegenheits- und Spezialposten
ausgeschlossen., welche sich immer als „wie gesehen so gekauft“
verstehen, unter Ausschluss jeglicher Garantie, einschließlich verborgenere Fehler. Es werden keine Reklamationen nach Ablauf einer Frist von
acht Tagen ab Lieferung des Materials anerkannt, auch nicht für bereits
verlegtes Material. Im Falle einer begründeten Reklamation innerhalb
der obengenannten Frist, kann die Verkaufsfirma, nach einem unanfechtbaren Urteil, die Rücknahme des Materials und den Austausch
desselben, oder als Alternative die Auflösung des Vertrags, veranlassen. Die Möglichkeit, seitens des Käufers, Ansprüche auf Schadenersatz zu erheben, wird auf jeden Fall ausgeschlossen. Folgende Gründe
können nicht Anlass für Beanstandungen sein: leichte Farbunterschiede die eine Eigenschaft der hoch-gesinterten Materialien sind.
Die Materialien 2. und 3. Wahl (Stock), sowie die Gelegenheitsposten
verstehen sich als „wie gesehen so gekauft“. Es werden keine Beanstandungen hinsichtlich leichter Unterschiede des Kalibers zwischen
den und den Spezialteilen (Stiegen, Sockel, Sondersockel, Fußleiste
etc.) anerkannt.
8 - KOMPETENZ – Für jeglichen Rechtsstreit, hinsichtlich Lieferung, ist
ausschließlich das Gericht von Modena zuständig.
Verpackung: kostenlos in Kartonschachteln
Paletten: je 6,50 Euro , einschliesslich Schrumpfverpackung
Lieferart: ab Werk in Sassuolo (MO)
MWST: zu Lasten des Auftraggebers
