CONDIZIONI GENERALI DI VENDITA
AVVERTENZE
A) LISTINO
I prezzi indicati sono IVA esclusa.
B) TERMINI DI CONSEGNA
Si intendono sempre a carattere indicativo anche se confermate dalla ditta; pertanto ritardo o mancanta consegna che dovessero
accadere per qualsiasi motivo, non costituiranno in nessun caso diritto a rivalere penalità o indennizo per lucro cessante.
C) RESA MERCE
Si intende franco magazzino cliente in italia.
Qualora la consegna della merce sia riferita a soli singoli complementi, questi verranno spediti tramite corrieri celeri con supplemento
di spese di trasporto in porto assegnato.
D) IMBALLO
L’imballaggio è già compreso nel prezzo, ed è costituito da buste di nylon e scatole di cartone.
E) PAGAMENTO TESSUTI
Le forniture dei soli tessuti verranno effettuate in porto assegnato con pagamenti in contrassegno.
F) CONTESTAZIONE E RESI
Eventuali reclami o contestazioni per danni derivanti da trasporto devono essere fatti al momento dello scarico al vettore; altre contestazioni dovranno pervenirci entro 2 giorni dal ricevimento della merce tramite lettera raccomandata. I resi, dovranno essere preventivamente concordati con la casa e riguarderanno solo merce intatta. In ogni caso non si sostituirà con nuovo prodotto quello contestato, ma si tratterà solo di ripristino della parte difettata.
In caso di mancato pagamento entro il termine concordato, senza alcun preavviso o messa in mora, l’importo non pagato verrà maggiorato oltre alle spese, di un interesse pari all’1,5% mensile.
1) TRASMISSIONE ORDINI
Gli ordini devono pervenire per iscritto anche via fax tramite apposita modulistica rilasciata dalla ditta.
Gli ordini trasmessi telefonicamente dovranno comunque essere confermati per iscritto. In difetto la ditta declina ogni responsabilità per
eventuali errori nell’evasione dell’ordine.
Disdette o variazioni di ordini anche parziali non saranno accettate qualora gli articoli siano in lavorazione.
2) MISURE E FUORI MISURA
Le misure dei prodotti riportati in listino comprendono le sporgenze esterne dei divani.
La ditta si riserva il diritto di apportare modifiche tecniche costruttive ed estetiche ai modelli in corso senza preavviso.
La fattibilità degli articoli fuori misura deve essere preventivamente verificata con la ditta e prevedono una maggiorazione del 25% sul
prezzo.
3) TESSUTI ABBINATI
I prodotti rivestiti con tessuti abbinati di categorie diverse verrano conteggiati al prezzo della categoria più alta.
4) TESSUTO CLIENTE
Il tessuto fornito dal cliente deve pervenirci esclusivamente in porto franco. Il tessuto deve indicare il diritto o rovescio e/o alto e basso
e qualora il tessuto avesse righe larghe, quadri e/o disegni a rapporto è necessario interpellare la ditta per una corretta verifica del
metraggio; in mancanza di tali dati della ditta non risponde di eventuali errori.
5) CARATTERISTICHE TESSUTI E TOLLERANZE
La ditta non è tecnicamente in grado di garantire l’identica tonalità di colore nei tessuti sia rispetto ai campionari sia da fornitura a
fornitura.
La composizione dei tessuti come pure le caratteristiche, sono quelle indicateci dalle tessiture produttrici; in osservanza alla LEGGE
n.883 del 26/11/73, le composizioni delle ns. stoffe sono specificate nel campionario tessuti.
Resta inteso che la vendita della merce sopra descritta viene effettuata con clausola di riservato dominio, per cui la proprietà di essa
passerà all’acquirente solamente quando ne avrà pagato integralmente il prezzo e se stabilito a rate, solamente al pagamento dell’ultima rata.
In caso di mancato pagamento di due terzi, la Ditta venditrice avrà il diritto di ritirare la merce senza restituzione della pena negata,
che tratterà a titolo di risarcimento danni. Per qualsiasi contestazione e controversia il foro sarà in via esclusiva quello di Pesaro anche
se il pagamento sia stabilito con tratte o cessioni. L’acquirente accetta la fornitura alle suddette condizioni generali di vendita.
GENERAL SALES CONDITIONS
A) PRICES
Prices shown do not include VAT.
B) DELIVERY TERMS
These are only indicative even when confirmed by the manufacturer; should delay or non delivery occur for any reason, this will not
constitute any right to compensation or penality for loss of profit or damages.
C) GOODS DELIVERY
This is intended carriage paid to the customer’s warehouse in Italy. In the case of single items, these will be sent by express courier
with the carriage charges to be paid by customer.
D) PACKAGING
The cost of packaging is already included and consists of nylos bags.
E) PAYMENT FOR FABRICS ONLY
The supply of fabrics on their owns will be made with carriage charged to customers or by cash on delivery.
F) COMPLAINTS AND RETURNED GOODS
Any eventual complaints or claims for damages arising from transportations must be made to the driver at the moment of delivery;
other claims must be received by us within 2 days of receiving goods by registered letter. The return of goods must be previously agreed with the manufacturer and can only cover goods which are intact. In any case, the goods will not be replaced with new items but the
defective part will be repaired. If payment is not received within the time period agreed, interest at the rate of 1,5% monthly will be
added to the outstanding amount, as expenses, without prior notification.
It is understood that the supply of the goods described above will be effected with a “right of possession” clause meaning that possession will only be transferred to the purchaser when the entire sum has been paid or in the case of payment by instalments only once
the final payment has been made. If two-thirds of the sum is not paid, the sellers will have the right to take back the goods without
reimbursing the third already paid which will be withheld as damage compensation. Any controversy or legal proceedings will be settled
under the jurisdiction of the Pesaro courts even if payment by bill of exchange or assignment of goods has been made. The purchaser
accepts the supply of goods on the basis of the above sales conditions.
ALLGEMEINE VERKAUFSBEDINGUNGEN
A) PREISLISTE
Bei den angegebenen Preisen ist die MWSt, nich inbegriffen.
B) LIEFERZEITEN
Sind immer nur indikativ, auch wenn sie von der Firma bestätigt werden,; Verzögerungen oder ausbleibende Lieferungen, aus welchem
Grund auch immer, stellen daher keinen Grund zur Forderung Strafen oder Schadensersatz für ausgebliebenen Verdienst.
C) WARENÜBERGABE
Versteht sich frei Lager des Kunden in Italien. Sollen nur einzelne Komplemente geliefert werden, so werden diese per Eilbote mit Zuschlag der Transportkosten als Fracht in Überweisung geschickt.
D) VERPACKUNG
Die Verpackung ist im Preis inklusiv. Sie besteht aus Nylontüten.
E) ZAHLUNG DER STOFFE
Die Lieferung von ausschließlich Stoffen erfolgt als Fracht in Überweisung oder gegen Zahlung per Nachname.
F) BEANSTANDUNGEN UND RÜCKSENDUNG
Mögliche Reklamationen oder Beanstandungen aufgrund von Schäden, die durch den Transport entstanden sind, müssen beim Abladen
gegen¨ber dem Fahrer geäußert werden. Weitere Beanstandungen müssen der Firma innerhalb von 2 Tagen nach Warenerhalt per
Einschreiben mitgeteilt werden. Die Rücksendung muß vorher mit unserem Hause abgesprochen werden und betrifft nur intakte Ware.
In keinem Fall wird der beanstandete Artikel durch einen neuen ersetzt, der defekte Teil wird lediglich instand gesetzt. Bei nicht erfolgter
Zahlung zum vereinbarten Termin wird der unbezahlte Betrag ohne Vorankündigung oder Anmahnung um 1,5 % monatlich erhöht und
Kosten in Rechnung gestellt.
Selbstverständlich erfolgt der Verkauf der oben genannten Ware mit der Klausel des Eigentumsvorbehaltes, deher ist sie erst als Eigentum der Käufer zu betrachten, wenn dieser den vollen Betrag, oder bei Ratenzahlung die lietzte Rate bezahlt hat. Fehlen zwei Drittel des
zu bezahlenden Betrages, hat die Firma das Recht, die Ware ohne Rückerstattung des bereits bezahlten Drittels einzuziehen, welchen
sie als Schadensersatz ansieht. Gerichtsstand für jegliche Auseinandersetzung ist Pesaro, auch wenn sich auf eine. Zahlung mit Tratten
und Wechselübertragungen geeinigt wurde. Der akzeptier die Lieferung zu den oben genannten allgemeinen Verkausbedingungen an.
GENERAL NOTES
1) PLACING ORDERS
Orders must be sent in writing, including fax, on the appropriate forms issued by the manufacturer. Telephone orders must in any case
be confirmed in writing. If this is not done the manufacturer declines all responsibility for eventual errors in executing the order. Order
cancellation or variations, even if only in part, cannot be accepted once preparation of the articles has commenced.
2) SIZES AND NON-STANDARD SIZES
The sizes of the items shown in the list include the external sofa and beds overhang. The manufacturer reserves the right to make any
modifications he sees as necessary to the structure and appearance of the standard models without giving prior notice. The possibility
of supplying models in non-standard size must be previously checked with the manufacturer.
3) MATCHED FABRICS
The price of items covered in fabrics from different categories will be calculated on the basis of the highest category fabric.
4) CUSTOMER FABRIC
The fabric supplied by the customer must be sent to us strictly carriage paid. Front and reserve and/or top and bottom of the fabric
must be clearly shown. If the fabric includes large stripes, squares and/or particular patterns, the manufacturer must be contacted
to check material length; if this information is not supplied, no responsibility can be accepted by the manufacturer for eventual errors
which may results.
5) FABRIC CHARACTERISTICS AND TOLERANCES
The manufacturer cannot technically guarantee that the shading of the fabric from one batch to the next is exactly the same as that of
the sample collections. Fabric compositions and characteristics are provided to us by the fabric manufacturers; the compositions of out
fabrics is specified in the sample collection, in accordance with NORM 883 of 26/11/73.
HINWEISE
1) BESTELLUNG
Bestellung müssen schriftlich, auch per Fax, auf von der Firma verteilten Formularen erfolgen.
Telefonische Bestellungen müssen schriftlich bestätigt werden. Geschieht dies nicht, übernimmt die Firma keine Haftung für eventuelle
Fehler bei der Ausführung der Bestellung. Annullierungen order Variationen können nicht akzeptiert werden, wenn die Artikel bereits in
Produktion sind.
2) MAßE UND SONDERMAßE
Die in der Preisliste angegebenen Maße verstehen sich einschließlich der äußerer Überstand der Sofa. Die Firma behält sich das Recht
vor, ohne Vorankündigung technische und ästhetische Veränderungen an den laufenden Modellen vorzunehmen. Eventuelle Sondermaße
müssen vorher mit der Firma abgesprochen werden.
3) KOMBINIERTE STOFFE
Bei Artikeln mit kombinierten Stoffen verschiedener Kategorien wird der Preis der teureren Kategorie berechnet.
4) STOFFE DES KUNDEN
Der vom Kunden gelieferte Stoff mussfrachtfrei bei uns eingehen. Auf dem Stoff müssen Vorder-, Hinter, Ober-und Unterseite angegeben sein, und sollte er breit gestreift, kariert oder gemustert sein, müssen gemeinsam mit der Firma die Meter überprüft werden;
fehlen diese Angaben, übernimmt die Firma keine Haftung für eventuelle Fehler.
5) EIGENSCHAFTEN UND VERTRÄGLICHKEIT DER STOFFE
Die Firma ist technisch gesehen nicht in der Lage bei der Lieferung eine dem Muster identische Farbtonalität der Stoffe zu gewährleisten. Die Zusammensetzung und Eigenschaften der Stoffe sind die von der Herstellerfirma angegebenen: nach GESETZ Nr. 883 vom
26/11/73, ist die Zusammensetzung unserer Stoffe im Stoff Mustersortiment angegeben.
