Requests must be submitted in duplicate with Italian translations and the letter of request must include the seal of the court and the signature of the judge. Moreover, the District Court of the District of Columbia has the authority to issue letters of request to facilitate the taking of depositions in a country that is a signatory to the Hague Convention. See, e.g., Miller v. Holzmann, 2006 WL 3093122 (D.D.C. Oct. 31, 2006) (granting motion to issue letters of request under Hague Convention). In this case, Hitachi Metals’ Letter of Request solicits international judicial assistance in obtaining evidence abroad pertinent to Hitachi Metals’ inquiry in the pending Investigation into alleged patent infringing imports of certain sintered rare earth magnets and products containing same, and meets the standards set forth for letters of request according to the Hague Convention. (collectively “Hitachi Metals”) on August 17, 2012. The complaint alleges that the respondents import, sell for importation and/or sell after importation certain sintered rare earth magnets or products containing sintered rare earth magnets that infringe Hitachi Metals’ U.S. Patent Nos. 6,461,565, 6,491,765, 6,527,874 and 6,537,385. On September 18, 2012, the Commission instituted proceedings based on Hitachi’s complaint and published notice of those proceedings in the Federal Register. The proceeding was transferred to Chief Administrative Law Judge Charles E. Bullock to preside over pretrial matters, conduct a trial, and issue an initial determination on the merits of the case. The initial determination of the Chief Administrative Law Judge is subject to possible review by the Commission, with a right to appeal to the United States Court of Appeals for the Federal Circuit. 8 sf-3248466 8. 9. INSTRUCTIONS 1. Each document that responds in whole or in part to any portion of any request is to be produced along with all non-identical drafts thereof in its entirety, without abbreviation or redaction, and as maintained in the ordinary course of business. 2. In producing documents, you are requested to provide all documents that are in Your possession, custody, or control, or in the possession, custody, or control of Your agents, consultants, representatives, officers, directors, affiliates, predecessors, and successors in interest, parents, divisions, subsidiaries, regional offices, assignees, trustees, employees, experts, attorneys, or anyone else acting on Your behalf or subject to Your control. 3 3. If the recipient and supplier are unable to concur upon the status of the subject information submitted as confidential business information within ten days from the date of notification of such disagreement, any party to this order may raise the issue of the designation of such a status to the Administrative Law Judge who will rule upon the matter. The Administrative Law Judge may sua sponte question the designation of the confidential status of any information and, after opportunity for hearing, may remove the confidentiality designation. 11. No less than 10 days (or any other period of time designated by the Administrative Law Judge) prior to the initial disclosure to a proposed expert of any confidential information submitted in accordance with paragraph 2, the party proposing to use such expert shall submit in writing the name of such proposed expert and his or her educational and detailed employment history to the supplier. If the dispute is not resolved on an informal basis within ten days of receipt of such notice of objections, the supplier shall submit immediately each objection to the Administrative Law Judge for a ruling. If the investigation is before the Commission the matter shall be submitted to the Commission for resolution. The submission of such confidential business information to such proposed expert shall be withheld pending the ruling of the Commission or the Administrative Law Judge. The terms of this paragraph shall be inapplicable to experts within the Commission or to experts from other govemmental agencies who are consulted with or used by the Commission. 12. If confidential business information submitted in accordance with paragraph 2 is disclosed to any person other than in the manner authorized by this protective order, the party responsible for the disclosure must immediately bring all pertinent facts relating to such disclosure to the attention of the supplier and the Administrative Law Judge and, without prejudice to other rights and remedies of the supplier, make every effort to prevent further disclosure by it or by the person who was the recipient of such information. 13. Upon final termination of this investigation, each recipient of confidential business information that is subject to this order shall assemble and return to the supplier all items containing such information submitted in accordance with paragraph 2 above, including all copies of such matter which may have been made. Alternatively, the parties subject to this order may, with the written consent of the supplier, destroy all items containing confidential business 7 information and certify to the supplier (or his counsel) that such destruction has taken place. This paragraph shall not apply to the Commission, including its investigative attomey, and the Administrative Law Judge, which shall retain such material pursuant to statutory requirements and for other recordkeeping purposes, but may destroy those additional copies in its possession which it regards as surplusage. INSTRUCTIONS 1. Each document that responds in whole or in part to any portion of any request is to be produced along with all non-identical drafts thereof in its entirety, without abbreviation or redaction, and as maintained in the ordinary course of business. 2. The Commission, the Administrative Law Judge, and the Commission investigative attorney acknowledge that any document or information submitted as confidential business information pursuant to paragraph 2 above is to be treated as such within the meaning of 5 U.S.C. § 552(b)(4) and 18 U.S.C. § 1905, subject to a contrary ruling, after hearing, by the Commission or its Freedom of Information Act Officer, or the Administrative Law Judge. When such information is made part of a pleading or is offered into the evidentiary record, the data set forth in 19 C.F.R. § 201.6 must be provided except during the time that the proceeding is pending before the Administrative Law Judge. If while an investigation is before the Administrative Law Judge, a party to this order who is to be a recipient of any business information designated as confidential and submitted in accordance with paragraph 2 disagrees with respect to such a designation, in full or in part, it shall notify the supplier in writing, and they will thereupon confer as to the status of the subject information proffered within the context of this order. If prior to, or at the time of such a conference, the supplier withdraws its designation of such information as being subject to this order, but nonetheless submits such information for purposes of the investigation; such supplier shall express the withdrawal, in writing, and serve such withdrawal upon all parties and the Administrative Law Judge. If the recipient and supplier are unable to concur upon the status of the subject information submitted as confidential business information within ten days from the date of notification of such disagreement, any party to this order may raise the issue of the designation of such a status to the Administrative Law Judge who will rule upon the matter. The Administrative Law Judge may sua sponte question the designation of the confidential status of any information and, after opportunity for hearing, may remove the confidentiality designation. 11. No less than 10 days (or any other period of time designated by the Administrative Law Judge) prior to the initial disclosure to a proposed expert of any confidential information submitted in accordance with paragraph 2, the party proposing to use such expert shall submit in writing the name of such proposed expert and his or her educational and detailed employment history to the supplier. If the supplier objects to the disclosure of such confidential business information to such proposed expert as inconsistent with the language or intent of this order or on other grounds, it shall notify the recipient in writing of its objection and the grounds therefore 6 prior to the initial disclosure. If the dispute is not resolved on an informal basis within ten days of receipt of such notice of objections, the supplier shall submit immediately each objection to the Administrative Law Judge for a ruling. If the investigation is before the Commission the matter shall be submitted to the Commission for resolution. The submission of such confidential business information to such proposed expert shall be withheld pending the ruling of the Commission or the Administrative Law Judge. The terms of this paragraph shall be inapplicable to experts within the Commission or to experts from other govemmental agencies who are consulted with or used by the Commission. 12. If confidential business information submitted in accordance with paragraph 2 is disclosed to any person other than in the manner authorized by this protective order, the party responsible for the disclosure must immediately bring all pertinent facts relating to such disclosure to the attention of the supplier and the Administrative Law Judge and, without prejudice to other rights and remedies of the supplier, make every effort to prevent further disclosure by it or by the person who was the recipient of such information. 13. Upon final termination of this investigation, each recipient of confidential business information that is subject to this order shall assemble and return to the supplier all items containing such information submitted in accordance with paragraph 2 above, including all copies of such matter which may have been made. Alternatively, the parties subject to this order may, with the written consent of the supplier, destroy all items containing confidential business 7 information and certify to the supplier (or his counsel) that such destruction has taken place. Per "elemento di terre rare", si intende lo scandio, l'ittrio, il lantanio, il cerio, lo praseodimio, il neodimio, il promezio, il samario, l'europio, il gadolinio, il terbio, il disprosio, l'olmio, l'erbio, il tulio, l'itterbio e il lutezio. 17. Per "magnete di terre rare", si intende ogni magnete che comprende almeno un elemento di terre rare. 18. Per "magnete fabbricato con terre rare", si intende ogni magnete che comprende almeno un elemento di terra rara ed è prodotto con un processo di sinterizzazione e/o ha un prodotto massimo di energia ((BH)max) maggiore di 15 MGOe a temperatura ambiente. 19. Per "Prodotto con magnete di terre rare" si intende qualsiasi prodotto che include un Magnete fabbricato con terre rare quale componente. ISTRUZIONI 1. Ogni documento che risponde in tutto o in parte ad una parte qualunque di qualsivoglia richiesta deve essere prodotto insieme a tutte le relative bozze non-identiche nella 3 loro interezza, senza abbreviazioni o riformulazioni, e come mantenuto nel normale svolgimento delle attività. 2. Nel fornire i documenti, Le viene richiesto di produrre tutti i documenti che sono in Suo possesso, custodia o controllo, o nel possesso, custodia o controllo dei suoi agenti, consulenti, rappresentanti, funzionari, direttori, affiliati, aventi causa o danti causa, controllanti, divisioni, controllate, uffici regionali, assegnatari, fiduciari, dipendenti, periti, avvocati, o chiunque altro agisca per Suo conto o sia soggetto al Suo controllo. 3. HML si riserva il diritto di rifiutare l'invio di informazioni memorizzate elettronicamente in qualsiasi altro formato, salvo previa richiesta e relativa autorizzazione scritta da parte della stessa HML. HML si riserva inoltre il diritto di richiedere le copie di tutte le informazioni memorizzate elettronicamente nel loro formato originale, ad esempio Microsoft Excel o Word. 4. Nel caso in cui qualsiasi documento reclamato in base a queste richieste venga trattenuto in tutto o in parte, sulla base di una pretesa di riservatezza del rapporto clienteavvocato, di una immunità del prodotto di manifattura, o di qualsiasi altra esenzione o immunità dall'obbligo di divulgazione, è necessario fornire un registro di tali privilegi che identifichi ogni documento per il quale si invoca il privilegio o l'immunità e che fornisca, con riferimento a ciascun documento, le seguenti informazioni: (i) la data in cui il documento è stato creato e modificato l'ultima volta, (ii) l'oggetto del documento, (iii) la persona che ha preparato il 4 documento e se tale persona è un avvocato, (iv) tutte le persone cui il documento è stato distribuito, mostrato, o illustrato e se tali persone sono avvocati, (v) l'attuale depositario del documento, e (vi) la natura del privilegio asserito. 5. RICHIESTA N. 2: Tutti i documenti che identificano ogni Prodotto con magnete di terre rare, che Lei ha fabbricato o assemblato o ha fatto fabbricare o assemblare da altri (negli Stati Uniti o altrove), o che Lei ha smerciato negli Stati Uniti, importato negli Stati Uniti, o venduto negli Stati Uniti o altrove, dal 1° gennaio 2011. RICHIESTA N. 3: Tutti i documenti che identificano e descrivono i processi utilizzati per la fabbricazione di ogni Magnete fabbricato con terre rare che Lei ha prodotto (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011 e la composizione chimica dei Magneti fabbricati con terre rare. RICHIESTA N. 4: Per qualsivoglia Magnete prodotto con terre rare o Prodotto con magnete di terre rare che Lei aveva fabbricato (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011, che Lei non ha fabbricato, tutti i documenti che identificano le entità che Le hanno fornito i Magneti prodotti con terre rare (sia come prodotto indipendente sia come componente di un altro prodotto fornitoLe) e le entità che hanno prodotto i Magneti fabbricati con terre rare. RICHIESTA N. 5: Tutti i documenti concernenti la catena di fornitura per qualsiasi Magnete fabbricato con terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli 6 Stati Uniti, o venduto negli Stati Uniti o altrove, dal 1° gennaio 2011, compresi i documenti relativi a qualsiasi parte della catena di fornitura, a partire dalla società che coltiva le miniere di terre rare e sino ai consumatori finali dei prodotti contenenti i Suoi Magneti fabbricati con terre rare. RICHIESTA N. 6: Tutte le comunicazioni e i documenti e le cose scambiati tra Lei e qualsivoglia produttore, fornitore o cliente di qualsivoglia Magnete prodotto con terre rare o Prodotto con magnete di terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, o venduto negli Stati Uniti o altrove dal 1° gennaio 2011, relativi ai processi utilizzati per la fabbricazione dei magneti fabbricati con terre rare. RICHIESTA N. 7: Tutti gli accordi tra Lei e qualsivoglia produttore, fornitore o cliente di qualsivoglia Magnete fabbricato con terre rare o Prodotto con magnete di terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, o venduto negli Stati Uniti o altrove dal 1° gennaio 2011, che riguardano, si riferiscono o sono relativi a qualsivoglia Magnete fabbricato con terre rare o ai processi utilizzati per la fabbricazione degli stessi. Se il Giudice amministrativo o la Commissione stabiliscono quanto sopra, il fornitore di tali informazioni avrà l'opportunità di giustificare la loro riservatezza prima che sia presa una decisione. 3. In assenza di permesso scritto del fornitore o di un ordine della Commissione o del Giudice amministrativo, i documenti riservati o le informazioni commerciali presentate in conformità con le disposizioni del paragrafo 2 non saranno comunicati a nessuno, fatto salvo per: (i) l'avvocato esterno delle parti di queste indagini, compreso il personale addetto alla segreteria e al supporto necessari che assistono tale avvocato; (ii) persone qualificate che ricevono le testimonianze relative a tali documenti o informazioni e il personale stenografico e impiegatizio necessario; (iii) esperti tecnici e il loro personale impiegati ai fini di questo contenzioso (fatto 2 salvo per i casi in cui essi siano impiegati, svolgano opera di consulenza o siano altrimenti affiliati a parti non governative o sono dipendenti di un produttore, venditore all'ingrosso, venditore al dettaglio o distributore nazionale o straniero dei prodotti, dispositivi o componenti oggetto di queste indagini); (iv) la Commissione, il Giudice amministrativo, il personale della Commissione e quello degli enti governativi autorizzati dalla Commissione; e (v) la Commissione, i suoi dipendenti e personale a contratto che svolgono le mansioni dei dipendenti della Commissione, al fine di redigere e mantenere la documentazione di queste indagini o procedimenti correlati per cui tali informazioni sono fornite, o nelle verifiche e indagini interne relative ai programmi od operazioni della Commissione ai sensi di 5 U.S.C. Appendice 3.1 4. Le informazioni commerciali riservate presentate in conformità con le disposizioni del paragrafo 2 non saranno comunicate alle persone designate al paragrafo 3(i)2 e (iii), a meno che tali persone non abbiano prima letto questo provvedimento e abbiano concordato per lettera presentata al Segretario di questa Commissione: (i) di essere vincolate dai termini di cui sopra; (ii) di non rivelare tali informazioni commerciali riservate a nessuno se non a un'altra persona designata nel paragrafo 3; e (iii) di utilizzare tali informazioni commerciali riservate esclusivamente ai fini di queste indagini. 5. Le informazioni commerciali riservate presentate alla Commissione o al Giudice amministrativo in merito a una mozione o altro procedimento che rientra nella sfera di queste indagini saranno presentate sigillate ai sensi del paragrafo 2 di cui sopra. Le parti di una trascrizione correlate a queste indagini e contenenti informazioni commerciali riservate presentate ai sensi del paragrafo 2 di cui sopra saranno fascicolate separatamente e presentate sigillate. Quando le informazioni commerciali riservate presentate in conformità con il paragrafo 2 di cui sopra sono incluse in una trascrizione autorizzata di una deposizione o allegato alla suddetta, si provvederà a istruire l'attuario del tribunale che trascrive la deposizione di fascicolare le parti riservate ed etichettarle separatamente come "INFORMAZIONI COMMERCIALI RISERVATE, SOGGETTE A PROVVEDIMENTO CAUTELARE". Prima che un attuario del tribunale o un traduttore riceva tali informazioni, egli/ella leggerà questo provvedimento e concorderà per iscritto di rispettare i termini del presente. In alternativa, firmerà l'accordo incluso come Allegato A al presente. Le copie di ogni documento firmato saranno fornite al fornitore delle informazioni commerciali riservate e al Segretario della Commissione. 7. Le restrizioni e gli obblighi relativi alle persone soggette a questo provvedimento non saranno validi per le informazioni presentate in conformità con il paragrafo 2 di cui sopra per cui la persona che asserisce lo stato di riservatezza delle suddette concordi per iscritto, oppure la Commissione o il Giudice amministrativo stabilisca, in seguito a un'udienza, che tali informazioni erano pubblicamente note nel momento in cui sono state fornite al destinatario o sono nel frattempo divenute di pubblico dominio per motivi non da ascrivere al destinatario. 4 8. La Commissione, il Giudice amministrativo e il legale della Commissione addetto alle indagini riconoscono che i documenti o le informazioni presentati come informazioni commerciali riservate in conformità con il paragrafo 2 di cui sopra devono essere trattati come tali entro il significato di 5 U.S.C. § 552(b)(4) e 18 U.S.C. § 1905, salvo decisione differente, in seguito a udienza, della Commissione o del suo Funzionario del Freedom of Information Act o del Giudice amministrativo. Quando tali informazioni sono rese parte di un atto processionale od inserite nei verbali, i dati di cui al 19 C.F.R. § 201.6 devono essere forniti, fatto salvo per il periodo in cui il procedimento è in corso dinanzi al Giudice amministrativo. Durante tale periodo, la parte che offre le informazioni commerciali riservate deve fornire su richiesta una dichiarazione sulla base rivendicata sulla sua riservatezza. 9. Fatto salvo per il ritiro di una designazione di riservatezza, o quando la Commissione o il Giudice amministrativo stabiliscono che le informazioni classificate come riservate non sono più tali, la Commissione, il Giudice amministrativo e il legale della Commissione addetto alle indagini attueranno tutte le misure necessarie e pertinenti per preservare la riservatezza e tutelare i diritti di ogni fornitore in merito alle informazioni commerciali riservate classificate dal fornitore ai sensi del paragrafo 2 di cui sopra, tra cui, senza limitazione: (a) notificando tempestivamente al fornitore (i) le richieste di informazioni o richieste sulla sostanza delle informazioni commerciali riservate o di accesso alle suddette da parte di persone diverse da quelle autorizzate, ai sensi di questo provvedimento, ai sensi del Freedom of Information Act e successive modifiche (5 U.S.C. § 552) e (ii) le proposte di riclassificare o rendere pubbliche le informazioni commerciali riservate; e (b) fornendo al fornitore almeno sette giorni dalla ricezione di tali richieste di informazioni o richieste entro cui agire dinanzi alla Commissione, al suo Funzionario del Freedom of Information Act o al Giudice 5 amministrativo o altrimenti preservare la riservatezza e tutelare i propri diritti su tali informazioni commerciali riservate. 10. Se durante un'indagine dinanzi al Giudice amministrativo, una parte di questo provvedimento destinataria di informazioni commerciali classificate come riservate e presentate in conformità con il paragrafo non concorda, in parte o per intero, con tale classificazione, informerà il fornitore per iscritto e conferirà sullo stato delle informazioni proferite entro il contesto di questo provvedimento. Se prima o durante una tale conferenza, il fornitore ritira la propria classificazione di tali informazioni come soggette a questo provvedimento, ma presenta comunque le informazioni ai fini delle indagini, il fornitore attesterà il ritiro per iscritto e presenterà tale ritiro a tutte le parti e il Giudice amministrativo. Se il destinatario e il fornitore non sono in grado di concordare sullo stato delle informazioni presentate come informazioni commerciali riservate, entro dieci giorni dalla data di notifica di tale disaccordo, le parti di questo provvedimento potranno portare il tema della designazione di tale stato all'attenzione del Giudice amministrativo, il quale delibererà in merito. Il Giudice amministrativo può contestare di sua iniziativa la designazione dello stato di riservatezza delle informazioni e, in seguito a un'udienza, può annullare la designazione di riservatezza. 11. Non meno di 10 giorni (o altro periodo di tempo stabilito dal Giudice amministrativo) prima della comunicazione iniziale a un esperto proposto delle informazioni riservate presentate in conformità al paragrafo 2, la parte che propone l'uso di tale esperto presenterà per iscritto al fornitore il nome dell'esperto e la sua esperienza formativa e professionale dettagliata. Se il fornitore obietta alla comunicazione di tali informazioni commerciali riservate all'esperto proposto, in quanto non coerente con il linguaggio e lo scopo di questo provvedimento o per altri motivi, informerà il destinatario per iscritto della sua obiezione 6 indicando i motivi, prima della divulgazione iniziale. Se la vertenza non è risolta in modo informale entro dieci giorni dalla ricezione di tale avviso di obiezione, il fornitore presenterà immediatamente ciascuna obiezione al Giudice amministrativo, il quale delibererà in merito. Se le indagini sono svolte dinanzi alla Commissione, il problema sarà sottoposto all'attenzione della Commissione per l'opportuna risoluzione. La presentazione delle informazioni commerciali riservate all'esperto proposto sarà sospesa in attesa della decisione della Commissione o del Giudice amministrativo. I termini di questo paragrafo non saranno validi per gli esperti della Commissione o gli esperti di altri enti governativi di cui la Commissione si avvale o che consulta. 12. Se le informazioni commerciali riservate presentate in conformità con il paragrafo 2 sono comunicate a persone in modo diverso da quello autorizzato da questo provvedimento cautelare, la parte responsabile della divulgazione dovrà portare immediatamente tutti i fatti pertinenti relativi alla divulgazione all'attenzione del fornitore e del Giudice amministrativo e, senza pregiudizio alcuno per altri diritti e rimedi del fornitore, fare quanto possibile per impedire l'ulteriore divulgazione da parte sua o della persona destinataria delle informazioni. 13. Nulla in questo provvedimento limiterà il diritto di una persona di richiedere il controllo giurisdizionale o altra azione giudiziaria pertinente in merito alle decisioni della Commissione, del suo Funzionario del Freedom of Information Act o del Giudice amministrativo sullo stato delle informazioni commerciali riservate. 14. Al termine di queste indagini, ogni destinatario delle informazioni commerciali riservate soggetto a questo provvedimento riunirà insieme e restituirà al fornitore tutto ciò che contiene tali informazioni presentate in conformità con il paragrafo 2 di cui sopra, comprese tutte le copie eventualmente prodotte. In alternativa, le parti soggette a questo provvedimento 7 possono, con il consenso scritto del fornitore, distruggere tutto ciò che contiene informazioni commerciali riservate e attestare al fornitore (o al suo avvocato) l'esecuzione della distruzione. Questo paragrafo non sarà valido per la Commissione, compreso il legale della Commissione addetto alle indagini, e il Giudice amministrativo, i quali conserveranno tale materiale ai sensi delle norme statutarie e ai fini dell'archiviazione; tuttavia, essi potranno distruggere le copie aggiuntive in loro possesso ritenute un'eccedenza. Ltd., DeWALT Industrial Tool Corp., AKG Acoustics GmbH , Harman International Industries, Maxon Precision Motors, Inc., Dr. Fritz Faulhaber GmBH & Co. KG, Micromo Electronics, Inc., Bosch Security Systems, Inc., Nexteer Automotive Corp., Bunting Magnetics Co., Viona Corp., nonché i relativi agenti, funzionari, dipendenti, rappresentanti, avvocati, e ogni e qualsiasi società, società di capitali, o impresa commerciale dante causa o avente causa. Tali termini inoltre fanno riferimento a qualsivoglia divisione, società, società di capitali o altra impresa commerciale affiliate con il Convenuto o partecipate da quest'ultimo in tutto o in parte, o che detengono il Convenuto in tutto o in parte, nonché agli amministratori, funzionari, agenti, dipendenti, consulenti e avvocati delle stesse, incluse tutte le persone che agiscono o affermano di agire per conto di, o che sono sottoposte alla direzione o al controllo di una qualsiasi delle entità succitate. 4. Il termine '"indagine" o "Indagine sottostante" indica l'Indagine n. 337-TA- 5. Per "Persona" o "Entità" si intendono le persone e le entità, tra cui tutte le 855. persone fisiche, le imprese, le ditte, le società di persone, le società collegate, le organizzazioni, gli enti governativi, le joint venture, le società, ed ogni altra entità. 6. I termini "e" e "o" sono termini inclusivi e non di esclusione e devono essere interpretati sia disgiuntamente sia congiuntamente a seconda dei casi per far rientrare nell'ambito di queste richieste i documenti o le risposte che possono essere altrimenti interpretati in modo da essere esclusi dall'ambito delle medesime. 7. I termini "per quanto riguarda" e "in relazione a" saranno interpretati come specificamente, per quanto concerne, in riferimento a, in relazione a, provando, dimostrando, riassumendo, rispecchiando, costituendo, contenendo, incorporando, citando, di pertinenza, commentando, collegato con, discutendo, descrivendo, analizzando , dimostrando, incluso, o relativamente a, in qualsiasi modo in attinenza ad un oggetto particolare, in tutto o in parte, direttamente o indirettamente. 8. Per "Comunicazione" si intende qualsiasi trasmissione, scambio o trasferimento di informazioni con qualsiasi mezzo, incluso, a mero titolo esemplificativo ma non esaustivo, le lettere, i numeri, le immagini, i simboli, i dati, le fotografie, e il suono. 11. Per "relativo a" si intende per quanto riguarda, in riferimento a, per quanto concerne, citando, riflettendo, di pertinenza di, analizzando, evidenziando, affermando, comprendente, specificamente, descrivendo, discutendo, documentando, commentando, trattando, comprensivo di, rispondente a, sostenendo, contraddicendo, compreso, contenente o costituente (in tutto o in parte), a seconda di quanto indicato dal contesto come appropriato. 12. L'uso di un verbo in qualsiasi tempo deve essere interpretato come l'uso del verbo in tutti gli altri tempi. 13. Il singolare di un termine includerà il plurale e il plurale di qualsiasi termine comprenderà anche il singolare. "E" ed "o", sono da intendersi sia disgiuntamente che congiuntamente in modo da assumere il senso più ampio possibile, per far rientrare nell'ambito della Richiesta tutte le informazioni che altrimenti potrebbero essere interpretate in modo da essere escluse da tale ambito. Il termine "tutti" è da intendersi nel senso di "qualsiasi' e "ogni" e viceversa. 2 14. "Incluso" deve essere interpretato come "incluso, a mero titolo esemplificativo ma non esaustivo" o "incluso, a mero titolo esemplificativo". 15. Per "identificare", "identità", "individuazione" e "identificazione" per quanto riguarda i Suoi prodotti, dispositivi, o altri articoli di fabbricazione si intendono le seguenti informazioni: (a) tutte le designazioni utilizzate da Lei internamente per tale prodotto, dispositivo o articolo di fabbricazione e (b) tutte le designazioni utilizzate da Lei pubblicamente per quel prodotto, dispositivo o articolo di fabbricazione, compresa la parte o il numero e il nome del modello. 16. Per "elemento di terre rare", si intende lo scandio, l'ittrio, il lantanio, il cerio, lo praseodimio, il neodimio, il promezio, il samario, l'europio, il gadolinio, il terbio, il disprosio, l'olmio, l'erbio, il tulio, l'itterbio e il lutezio. 17. Per "magnete di terre rare", si intende ogni magnete che comprende almeno un elemento di terre rare. 18. Per "magnete fabbricato con terre rare", si intende ogni magnete che comprende almeno un elemento di terra rara ed è prodotto con un processo di sinterizzazione e/o ha un prodotto massimo di energia ((BH)max) maggiore di 15 MGOe a temperatura ambiente. 19. Per "Prodotto con magnete di terre rare" si intende qualsiasi prodotto che include un Magnete fabbricato con terre rare quale componente. ISTRUZIONI 1. Ogni documento che risponde in tutto o in parte ad una parte qualunque di qualsivoglia richiesta deve essere prodotto insieme a tutte le relative bozze non-identiche nella 3 loro interezza, senza abbreviazioni o riformulazioni, e come mantenuto nel normale svolgimento delle attività. 2. Nel fornire i documenti, Le viene richiesto di produrre tutti i documenti che sono in Suo possesso, custodia o controllo, o nel possesso, custodia o controllo dei suoi agenti, consulenti, rappresentanti, funzionari, direttori, affiliati, aventi causa o danti causa, controllanti, divisioni, controllate, uffici regionali, assegnatari, fiduciari, dipendenti, periti, avvocati, o chiunque altro agisca per Suo conto o sia soggetto al Suo controllo. 3. Tutti i documenti che costituiscono informazioni memorizzate elettronicamente, termine che assumerà il significato ad esso attribuito dal Regolamento federale di procedura civile, saranno forniti nel formato dei file Concordia .dat contenenti immagini .tif con il relativo testo dei documenti riconosciuti tramite OCR, per ogni singola pagina. HML si riserva il diritto di rifiutare l'invio di informazioni memorizzate elettronicamente in qualsiasi altro formato, salvo previa richiesta e relativa autorizzazione scritta da parte della stessa HML. HML si riserva inoltre il diritto di richiedere le copie di tutte le informazioni memorizzate elettronicamente nel loro formato originale, ad esempio Microsoft Excel o Word. 4. Nel caso in cui qualsiasi documento reclamato in base a queste richieste venga trattenuto in tutto o in parte, sulla base di una pretesa di riservatezza del rapporto clienteavvocato, di una immunità del prodotto di manifattura, o di qualsiasi altra esenzione o immunità dall'obbligo di divulgazione, è necessario fornire un registro di tali privilegi che identifichi ogni documento per il quale si invoca il privilegio o l'immunità e che fornisca, con riferimento a ciascun documento, le seguenti informazioni: (i) la data in cui il documento è stato creato e modificato l'ultima volta, (ii) l'oggetto del documento, (iii) la persona che ha preparato il 4 documento e se tale persona è un avvocato, (iv) tutte le persone cui il documento è stato distribuito, mostrato, o illustrato e se tali persone sono avvocati, (v) l'attuale depositario del documento, e (vi) la natura del privilegio asserito. 5. Contrassegnare ogni pagina che si ritiene contenga informazioni riservate in conformità con il Provvedimento cautelare emesso dal Giudice Amministrativo Bullock in questa indagine. RICHIESTE RICHIESTA N. 1: 5 Tutti i documenti che identificano ogni Magnete fabbricato con terre rare che Lei ha prodotto, ha fatto produrre (negli Stati Uniti o altrove), ha importato negli Stati Uniti, o venduto, sia negli Stati Uniti sia altrove, dal 1° gennaio 2011. RICHIESTA N. 2: Tutti i documenti che identificano ogni Prodotto con magnete di terre rare, che Lei ha fabbricato o assemblato o ha fatto fabbricare o assemblare da altri (negli Stati Uniti o altrove), o che Lei ha smerciato negli Stati Uniti, importato negli Stati Uniti, o venduto negli Stati Uniti o altrove, dal 1° gennaio 2011. RICHIESTA N. 3: Tutti i documenti che identificano e descrivono i processi utilizzati per la fabbricazione di ogni Magnete fabbricato con terre rare che Lei ha prodotto (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011 e la composizione chimica dei Magneti fabbricati con terre rare. RICHIESTA N. 4: Per qualsivoglia Magnete prodotto con terre rare o Prodotto con magnete di terre rare che Lei aveva fabbricato (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011, che Lei non ha fabbricato, tutti i documenti che identificano le entità che Le hanno fornito i Magneti prodotti con terre rare (sia come prodotto indipendente sia come componente di un altro prodotto fornitoLe) e le entità che hanno prodotto i Magneti fabbricati con terre rare. RICHIESTA N. 5: Tutti i documenti concernenti la catena di fornitura per qualsiasi Magnete fabbricato con terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli 6 Stati Uniti, o venduto negli Stati Uniti o altrove, dal 1° gennaio 2011, compresi i documenti relativi a qualsiasi parte della catena di fornitura, a partire dalla società che coltiva le miniere di terre rare e sino ai consumatori finali dei prodotti contenenti i Suoi Magneti fabbricati con terre rare. RICHIESTA N. 6: Tutte le comunicazioni e i documenti e le cose scambiati tra Lei e qualsivoglia produttore, fornitore o cliente di qualsivoglia Magnete prodotto con terre rare o Prodotto con magnete di terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, o venduto negli Stati Uniti o altrove dal 1° gennaio 2011, relativi ai processi utilizzati per la fabbricazione dei magneti fabbricati con terre rare. RICHIESTA N. 7: Tutti gli accordi tra Lei e qualsivoglia produttore, fornitore o cliente di qualsivoglia Magnete fabbricato con terre rare o Prodotto con magnete di terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, o venduto negli Stati Uniti o altrove dal 1° gennaio 2011, che riguardano, si riferiscono o sono relativi a qualsivoglia Magnete fabbricato con terre rare o ai processi utilizzati per la fabbricazione degli stessi. RICHIESTA N. 8: Tutti i documenti riguardanti l'acquisto, la distribuzione, la fornitura e/o la vendita da parte Sua di qualsivoglia Magnete fabbricato con terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011, inclusi tutti i documenti sufficienti a identificare l'acquisto, la distribuzione, la fornitura o i canali di vendita per tali magneti. 7 RICHIESTA N. 9: Tutti i documenti riguardanti le Sue vendite di Magneti fabbricati con terre rare o Prodotti con magnete di terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011, inclusi i documenti che identificano il nome e l'ubicazione dei clienti, le quantità vendute, i prezzi di vendita, e la tempistica con cui le vendite sono state effettuate. RICHIESTA N. 10: I documenti sufficienti a illustrare i costi o la struttura dei costi con riferimento a qualsiasi Magnete fabbricato con terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011. RICHIESTA N. 11: I documenti sufficienti a determinare, su base mensile o trimestrale, il numero totale di unità di prodotto vendute negli Stati Uniti per ogni Magnete prodotto con terre rare e Prodotto con magnete di terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011. RICHIESTA N. 13: Tutti i documenti che costituiscono o riguardano eventuali accordi di licenza tra Lei e qualsivoglia terzo in merito a qualsiasi Magnete prodotto con terre rare o Prodotto con magnete di terre rare che Lei ha fabbricato, ha fatto fabbricare (negli Stati Uniti o altrove), importato negli Stati Uniti, venduto negli Stati Uniti, o venduto per l'importazione negli Stati Uniti dal 1° gennaio 2011. Per "elemento di terre rare", si intende lo scandio, l'ittrio, il lantanio, il cerio, lo praseodimio, il neodimio, il promezio, il samario, l'europio, il gadolinio, il terbio, il disprosio, l'olmio, l'erbio, il tulio, l'itterbio e il lutezio. 17. Per "magnete di terre rare", si intende ogni magnete che comprende almeno un elemento di terre rare. 18. Per "magnete fabbricato con terre rare", si intende ogni magnete che comprende almeno un elemento di terra rara ed è prodotto con un processo di sinterizzazione e/o ha un prodotto massimo di energia ((BH)max) maggiore di 15 MGOe a temperatura ambiente. 19. Per "Prodotto con magnete di terre rare" si intende qualsiasi prodotto che include un Magnete fabbricato con terre rare quale componente. 3 SOGGETTI DI DEPOSIZIONE Le viene richiesto di designare una o più persone per testimoniare sui seguenti soggetti: 1. Identificazione dei Suoi Magneti fabbricati con terre rare. 2. Identificazione dei Suoi Prodotti con magnete di terre rare. 3. PROVVEDIMENTO CAUTELARE (21 settembre 2012) PREMESSO CHE, è possibile cercare, produrre o esibire da e tra le parti del procedimento in oggetto di cui sopra documenti e informazioni relativi a segreti commerciali o altra ricerca riservata, informazioni di sviluppo o commerciali, in quanto tali termini sono usati nelle Norme della Commissione, 19 C.F.R. § 210.5; SI ORDINA QUANTO SEGUE: 1. Le informazioni commerciali riservate sono informazioni che interessano o si riferiscono a segreti commerciali, processi, operazioni, stile di lavoro o apparati, o alla produzione, vendita, spedizione, acquisto, trasferimento, identificazione dei clienti, inventari, quantità o fonte di introiti, profitti, perdite o spese di qualsiasi persona, ditta, partnership, corporation o altra organizzazione, o altre informazioni di valore commerciale, la cui divulgazione avrà probabilmente l'effetto di (i) ostacolare la capacità della Commissione di ottenere tali informazioni come necessario per ottemperare ai propri incarichi legali o (ii) causare danni sostanziali alla posizione concorrenziale della persona, ditta, partnership, corporation o altra organizzazione che ha fornito le informazioni, a meno che la Commissione non sia obbligata per legge a rendere note tali informazioni. Il termine "informazioni 1 commerciali riservate" comprende le "informazioni proprietarie" entro il significato della sezione 777(b) del Tariff Act of 1930 (19 U.S.C. § 1677f(b)). 2(a). Le informazioni presentate in un'udienza preliminare, arringa, mozione o risposta a una mozione sia volontariamente sia in conformità con un ordine, in queste indagini, che secondo il fornitore contengono o costituiscono informazioni commerciali riservate saranno classificate come tali per iscritto dal fornitore od oralmente nel corso di una deposizione, conferenza o udienza e saranno separate dalle altre informazioni fornite. Tali informazioni, siano esse presentate per iscritto o in una testimonianza orale, saranno trattate in base ai termini di questo provvedimento cautelare. (b). Il Giudice amministrativo o la Commissione possono stabilire che le informazioni ritenute riservate non sono riservate o che la loro divulgazione è necessaria per lo svolgimento adeguato del procedimento, prima, durante e dopo il termine dell'udienza. Se il Giudice amministrativo o la Commissione stabiliscono quanto sopra, il fornitore di tali informazioni avrà l'opportunità di giustificare la loro riservatezza prima che sia presa una decisione. 3. In assenza di permesso scritto del fornitore o di un ordine della Commissione o del Giudice amministrativo, i documenti riservati o le informazioni commerciali presentate in conformità con le disposizioni del paragrafo 2 non saranno comunicati a nessuno, fatto salvo per: (i) l'avvocato esterno delle parti di queste indagini, compreso il personale addetto alla segreteria e al supporto necessari che assistono tale avvocato; (ii) persone qualificate che ricevono le testimonianze relative a tali documenti o informazioni e il personale stenografico e impiegatizio necessario; (iii) esperti tecnici e il loro personale impiegati ai fini di questo contenzioso (fatto 2 salvo per i casi in cui essi siano impiegati, svolgano opera di consulenza o siano altrimenti affiliati a parti non governative o sono dipendenti di un produttore, venditore all'ingrosso, venditore al dettaglio o distributore nazionale o straniero dei prodotti, dispositivi o componenti oggetto di queste indagini); (iv) la Commissione, il Giudice amministrativo, il personale della Commissione e quello degli enti governativi autorizzati dalla Commissione; e (v) la Commissione, i suoi dipendenti e personale a contratto che svolgono le mansioni dei dipendenti della Commissione, al fine di redigere e mantenere la documentazione di queste indagini o procedimenti correlati per cui tali informazioni sono fornite, o nelle verifiche e indagini interne relative ai programmi od operazioni della Commissione ai sensi di 5 U.S.C. Appendice 3.1 4. Le informazioni commerciali riservate presentate in conformità con le disposizioni del paragrafo 2 non saranno comunicate alle persone designate al paragrafo 3(i)2 e (iii), a meno che tali persone non abbiano prima letto questo provvedimento e abbiano concordato per lettera presentata al Segretario di questa Commissione: (i) di essere vincolate dai termini di cui sopra; (ii) di non rivelare tali informazioni commerciali riservate a nessuno se non a un'altra persona designata nel paragrafo 3; e (iii) di utilizzare tali informazioni commerciali riservate esclusivamente ai fini di queste indagini. 5. Il personale addetto alla segreteria e al supporto necessari che assistono l'avvocato non devono firmare il provvedimento cautelare, in quanto sono coperti dalla firma dell'avvocato sul provvedimento. 2 3 Giudice amministrativo ritenga che le informazioni non siano informazioni commerciali riservate come definito al paragrafo 1 del presente. 6. Le informazioni commerciali riservate presentate alla Commissione o al Giudice amministrativo in merito a una mozione o altro procedimento che rientra nella sfera di queste indagini saranno presentate sigillate ai sensi del paragrafo 2 di cui sopra. Le parti di una trascrizione correlate a queste indagini e contenenti informazioni commerciali riservate presentate ai sensi del paragrafo 2 di cui sopra saranno fascicolate separatamente e presentate sigillate. Quando le informazioni commerciali riservate presentate in conformità con il paragrafo 2 di cui sopra sono incluse in una trascrizione autorizzata di una deposizione o allegato alla suddetta, si provvederà a istruire l'attuario del tribunale che trascrive la deposizione di fascicolare le parti riservate ed etichettarle separatamente come "INFORMAZIONI COMMERCIALI RISERVATE, SOGGETTE A PROVVEDIMENTO CAUTELARE". Prima che un attuario del tribunale o un traduttore riceva tali informazioni, egli/ella leggerà questo provvedimento e concorderà per iscritto di rispettare i termini del presente. In alternativa, firmerà l'accordo incluso come Allegato A al presente. Le copie di ogni documento firmato saranno fornite al fornitore delle informazioni commerciali riservate e al Segretario della Commissione. 7. Le restrizioni e gli obblighi relativi alle persone soggette a questo provvedimento non saranno validi per le informazioni presentate in conformità con il paragrafo 2 di cui sopra per cui la persona che asserisce lo stato di riservatezza delle suddette concordi per iscritto, oppure la Commissione o il Giudice amministrativo stabilisca, in seguito a un'udienza, che tali informazioni erano pubblicamente note nel momento in cui sono state fornite al destinatario o sono nel frattempo divenute di pubblico dominio per motivi non da ascrivere al destinatario. 4 8. La Commissione, il Giudice amministrativo e il legale della Commissione addetto alle indagini riconoscono che i documenti o le informazioni presentati come informazioni commerciali riservate in conformità con il paragrafo 2 di cui sopra devono essere trattati come tali entro il significato di 5 U.S.C. § 552(b)(4) e 18 U.S.C. § 1905, salvo decisione differente, in seguito a udienza, della Commissione o del suo Funzionario del Freedom of Information Act o del Giudice amministrativo. Quando tali informazioni sono rese parte di un atto processionale od inserite nei verbali, i dati di cui al 19 C.F.R. § 201.6 devono essere forniti, fatto salvo per il periodo in cui il procedimento è in corso dinanzi al Giudice amministrativo. Durante tale periodo, la parte che offre le informazioni commerciali riservate deve fornire su richiesta una dichiarazione sulla base rivendicata sulla sua riservatezza. 9. Fatto salvo per il ritiro di una designazione di riservatezza, o quando la Commissione o il Giudice amministrativo stabiliscono che le informazioni classificate come riservate non sono più tali, la Commissione, il Giudice amministrativo e il legale della Commissione addetto alle indagini attueranno tutte le misure necessarie e pertinenti per preservare la riservatezza e tutelare i diritti di ogni fornitore in merito alle informazioni commerciali riservate classificate dal fornitore ai sensi del paragrafo 2 di cui sopra, tra cui, senza limitazione: (a) notificando tempestivamente al fornitore (i) le richieste di informazioni o richieste sulla sostanza delle informazioni commerciali riservate o di accesso alle suddette da parte di persone diverse da quelle autorizzate, ai sensi di questo provvedimento, ai sensi del Freedom of Information Act e successive modifiche (5 U.S.C. § 552) e (ii) le proposte di riclassificare o rendere pubbliche le informazioni commerciali riservate; e (b) fornendo al fornitore almeno sette giorni dalla ricezione di tali richieste di informazioni o richieste entro cui agire dinanzi alla Commissione, al suo Funzionario del Freedom of Information Act o al Giudice 5 amministrativo o altrimenti preservare la riservatezza e tutelare i propri diritti su tali informazioni commerciali riservate. 10. Se durante un'indagine dinanzi al Giudice amministrativo, una parte di questo provvedimento destinataria di informazioni commerciali classificate come riservate e presentate in conformità con il paragrafo non concorda, in parte o per intero, con tale classificazione, informerà il fornitore per iscritto e conferirà sullo stato delle informazioni proferite entro il contesto di questo provvedimento. Se prima o durante una tale conferenza, il fornitore ritira la propria classificazione di tali informazioni come soggette a questo provvedimento, ma presenta comunque le informazioni ai fini delle indagini, il fornitore attesterà il ritiro per iscritto e presenterà tale ritiro a tutte le parti e il Giudice amministrativo. Se il destinatario e il fornitore non sono in grado di concordare sullo stato delle informazioni presentate come informazioni commerciali riservate, entro dieci giorni dalla data di notifica di tale disaccordo, le parti di questo provvedimento potranno portare il tema della designazione di tale stato all'attenzione del Giudice amministrativo, il quale delibererà in merito. Il Giudice amministrativo può contestare di sua iniziativa la designazione dello stato di riservatezza delle informazioni e, in seguito a un'udienza, può annullare la designazione di riservatezza. 11. Non meno di 10 giorni (o altro periodo di tempo stabilito dal Giudice amministrativo) prima della comunicazione iniziale a un esperto proposto delle informazioni riservate presentate in conformità al paragrafo 2, la parte che propone l'uso di tale esperto presenterà per iscritto al fornitore il nome dell'esperto e la sua esperienza formativa e professionale dettagliata. Se il fornitore obietta alla comunicazione di tali informazioni commerciali riservate all'esperto proposto, in quanto non coerente con il linguaggio e lo scopo di questo provvedimento o per altri motivi, informerà il destinatario per iscritto della sua obiezione 6 indicando i motivi, prima della divulgazione iniziale. Se la vertenza non è risolta in modo informale entro dieci giorni dalla ricezione di tale avviso di obiezione, il fornitore presenterà immediatamente ciascuna obiezione al Giudice amministrativo, il quale delibererà in merito. Se le indagini sono svolte dinanzi alla Commissione, il problema sarà sottoposto all'attenzione della Commissione per l'opportuna risoluzione. La presentazione delle informazioni commerciali riservate all'esperto proposto sarà sospesa in attesa della decisione della Commissione o del Giudice amministrativo. I termini di questo paragrafo non saranno validi per gli esperti della Commissione o gli esperti di altri enti governativi di cui la Commissione si avvale o che consulta. 12. Se le informazioni commerciali riservate presentate in conformità con il paragrafo 2 sono comunicate a persone in modo diverso da quello autorizzato da questo provvedimento cautelare, la parte responsabile della divulgazione dovrà portare immediatamente tutti i fatti pertinenti relativi alla divulgazione all'attenzione del fornitore e del Giudice amministrativo e, senza pregiudizio alcuno per altri diritti e rimedi del fornitore, fare quanto possibile per impedire l'ulteriore divulgazione da parte sua o della persona destinataria delle informazioni. 13. Nulla in questo provvedimento limiterà il diritto di una persona di richiedere il controllo giurisdizionale o altra azione giudiziaria pertinente in merito alle decisioni della Commissione, del suo Funzionario del Freedom of Information Act o del Giudice amministrativo sullo stato delle informazioni commerciali riservate. 14. Al termine di queste indagini, ogni destinatario delle informazioni commerciali riservate soggetto a questo provvedimento riunirà insieme e restituirà al fornitore tutto ciò che contiene tali informazioni presentate in conformità con il paragrafo 2 di cui sopra, comprese tutte le copie eventualmente prodotte. In alternativa, le parti soggette a questo provvedimento 7 possono, con il consenso scritto del fornitore, distruggere tutto ciò che contiene informazioni commerciali riservate e attestare al fornitore (o al suo avvocato) l'esecuzione della distruzione. Questo paragrafo non sarà valido per la Commissione, compreso il legale della Commissione addetto alle indagini, e il Giudice amministrativo, i quali conserveranno tale materiale ai sensi delle norme statutarie e ai fini dell'archiviazione; tuttavia, essi potranno distruggere le copie aggiuntive in loro possesso ritenute un'eccedenza. Fatto salvo per quanto disposto nel paragrafo precedente, le informazioni commerciali riservate possono essere trasmesse a un tribunale distrettuale ai sensi della Norma della Commissione 210.5(c). 15.
